{"data":{"id":"us-ky/krs-243.240","jurisdiction":"us-ky","citation":"KRS 243.240","heading":"Business authorized by quota retail package  license -- Delivery of","body":"alcoholic beverages purchased on premises by consumers.\n(1) A quota retail package license shall authorize the licensee to:\n(a) Purchase, receive, possess, and sell distilled spirits and wine at retail in\nunbroken  packages only, and only for consumption off the licensed\npremises;\n(b) Deliver to the consumer, at the consumer's request, alcoholic beverages\nthat are purchased from the licensed premises, in quantities not to exceed\nfour and one-half (4 1/2) liters of distilled spirits and four (4) cases of wine\nper consumer per day for sales prior to January 1, 2021, and in quantities\nnot to exceed an aggregate of nine (9) liters of distilled spirits and four (4)\ncases of wine per consumer per day on and after January 1, 2021; and\n(c) 1. Sell distilled spirits and wine in unbroken packages only at fairs and\nfestivals held in wet territory if the fair or festival is located in the\nsame  county as the quota retail package license holder's licensed\npremises; and\n2. Notwithstanding KRS  243.0307, sell and provide samples of distilled\nspirits and wine at fairs and festivals held in wet territory if the fair or\nfestival is located in the same  county as the quota retail package\nlicense holder's licensed premises.\n(2) The  licensee shall purchase distilled spirits and wine in retail packages only\nand only from:\n(a) Licensed wholesalers;\n(b) Those  licensees authorized to sell distilled spirits and wine by the\npackage at retail, but only if the distilled spirits and wine have first gone\nthrough the three (3) tier system; or\n(c) From a distillery souvenir gift shop.\n(3) The  restrictions and permissions for sales to quota retail package licensees\nand to consumers that are authorized under KRS  243.0305(4) shall supersede\nany conflicting provisions of this section.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52068","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:53Z","sha256":"d933226ddeb49b75033897a81685a5f23b95cc0956008e99c34ebb914b3b0aef","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.238","next":"us-ky/krs-243.241"},"notice":"GroundRules: Original legal text.
