{"data":{"id":"us-ky/krs-243.390","jurisdiction":"us-ky","citation":"KRS 243.390","heading":"Sworn information to be contained in applications -- Verified","body":"supplemental statement -- Presumption of reliability of supplied information --\nExemption.\n(1) The board may require through the promulgation of an administrative regulation\nthat license applications contain the following information, given under oath:\n(a) The name, age, Social Security number, address, residence, and citizenship of\neach applicant;\n(b) If the applicant is a partner, the name, age, Social Security number, address,\nresidence, and citizenship of each partner and the name and address of the\npartnership;\n(c) The name, age, Social Security number, address, residence, and citizenship of\neach individual or partner interested in the business for which the license is\nsought, tog ether with the nature of that interest, and, if the applicant is a\ncorporation, limited partnership company, limited liability company, or other\nbusiness entity recognized by law, the name, age, Social Security number, and\naddress of each principal owner, member, officer, and director of the\napplicant. The department may require the names of all owners and the\nownership percentage held by each;\n(d) The premises to be licensed, stating the street and number, if the premises has\na street number, and a descrip tion that will reasonably indicate the location of\nthe premises;\n(e) 1. A statement that neither the applicant nor any other person referred to in\nthis section has been convicted of:\na. Any misdemeanor directly or indirectly attributable to alcoholic\nbeverages or cannabis-infused beverages;\nb. Any violation involving a controlled substance that is described in\nor classified pursuant to KRS Chapter 218A within the two (2)\nyears immediately preceding the application;\nc. Any felony, within five (5) years from the later of the date of\nparole or the date of conviction; or\nd. Providing false information to the department preceding the\napplication; and\n2. A statement that the applicant or any other person referred to in this\nsection has not had any license that has been issued under KRS Chapters\n241 to 244 revoked for cause within two (2) years prior to the date of the\napplication;\n(f) A statement that the applicant will in good faith abide by every state and local\nstatute, regulation, and ordinance relating to the manufacture, sale, use of, and\ntrafficking in alcoholic beverages or cannabis-infused beverages; and\n(g) Any other information necessary for the department to administer KRS\nChapters 241 to 244.\n(2) If, after a license has been issued, there is a change in any of the facts required to be\nset forth in the application, a verified supplemental statement in writing giving\nnotice of the change shall be filed with the department within ten (10) days after the\nchange.\n(3) In giving any notice or taking any action in reference to a license, the department\nmay rely upon the information furnished in the application or in the supplemental\nstatement connected with the application. This information, as against the licensee\nor applicant, shall be conclusively presumed to be correct. The information required\nto be furnished in the application or supplemental statement shall be deemed\nmaterial in any prosecution for perjury.\n(4) A direct shipper license applicant shall be exempt from th e requirements of this\nsection and shall instead meet the requirements for its license type as set forth in\nKRS 243.027.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55936","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:53Z","sha256":"3fe2b0f9dd839f9e510de55bbcadb5a025cb8b14530bc19cdc8a74def7b41d78","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.380","next":"us-ky/krs-243.400"},"notice":"GroundRules: Original legal text.
