{"data":{"id":"us-ky/krs-243.401","jurisdiction":"us-ky","citation":"KRS 243.401","heading":"Department to regulate distribution and retail sale of cannabis -infused","body":"beverages -- Conditions for sale -- Sales to persons under age 21 prohibited --\nPermitted activities by manufacturers -- Shipping and delivery.\n(1) (a) The distribution and  retail sale of cannabis -infused beverages shall be\nregulated solely by the Department of Alcoholic Beverage Control. The\ndepartment shall adopt and exclusively enforce the administrative regulations\nof the Department for Public Health relating to the dist ribution and retail sale\nof cannabis-infused beverages until such time as the Department of Alcoholic\nBeverage Control promulgates its own administrative regulations on the\nsubject on or before July 1, 2026.\n(b) The distribution and retail sale of packaged  cannabis-infused beverages shall\nbe regulated by the department. On or before July 1, 2026, the department\nshall promulgate administrative regulations in accordance with KRS Chapter\n13A to establish the rules and procedures for this distribution and retail sale.\n(c) A local administrator shall only have authority over the distribution and retail\nsale of cannabis -infused beverages in its territory to the extent expressly\nauthorized by KRS Chapters 241 to 244.\n(2) Cannabis-infused beverages shall only be available for retail sale:\n(a) By the package;\n(b) In wet territory; and\n(c) By the holder of both a quota retail package license and a cannabis -infused\nbeverage retail package license.\n(3) A person under twenty -one (21) years of age shall not purchase or co nsume\ncannabis-infused beverages. All restrictions and offenses related to minors and\nalcoholic beverages in KRS Chapters 241 to 244 shall also apply in the same\nmanner to minors and cannabis-infused beverages.\n(4) If approved as a cannabis -infused beverage manufacturer by the Department for\nPublic Health, that manufacturer may:\n(a) Self-distribute cannabis -infused beverages in the same manner as distilled\nspirits; and\n(b) Ship cannabis -infused beverages under a dire ct shipper license in the same\nmanner that a direct shipper license allows the shipment of alcoholic\nbeverages. A direct shipper licensee may sell or ship to a consumer all types\nof alcoholic beverages and cannabis -infused beverages that the licensee is\nauthorized to sell.\n(5) Cannabis-infused beverages may be shipped and delivered in the same manner as\nalcoholic beverages.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55922","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:53Z","sha256":"8375fa9b054e16575742bf9759633e6c1dd72a52f106a15f1521cff4b44fc602","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.400","next":"us-ky/krs-243.403"},"notice":"GroundRules: Original legal text.
