{"data":{"id":"us-ky/krs-243.480","jurisdiction":"us-ky","citation":"KRS 243.480","heading":"Suspension of licenses -- Payments in lieu of suspension -- Appeal.","body":"(1) Upon proceedings for the revocation of any license under KRS 243.520, the\nAlcoholic Beverage Control Board, or the local administrator, may in its or his or\nher discretion order a suspension of the license for any cause for which it may, but\nis not required to, revoke the license under the provisions of KRS 243.490 and\n243.500. However, the licensee may have the alternative, subject to the approval of\nthe Alcoholic Beverag e Control Board or the local administrator, to pay in lieu of\npart or all of the days of any suspension period, a sum as follows:\n(a) Except for violations arising from retail sales activities, including sales under\nlicenses issued pursuant to KRS 243.086 and sales at retail under KRS\n243.0305:\n1. Distillers, rectifiers, wineries, and brewers, one thousand dollars\n($1,000) per day;\n2. Wholesale distilled spirits and wine licensees, four hundred dollars\n($400) per day;\n3. Wholesale malt beverage licensees, four hundred dollars ($400) per day;\nand\n4. Cannabis-infused beverage distributor's license, four hundred dollars\n($400) per day;\n(b) 1. Retail licensees authorized to sell distilled spirits, wine, or malt\nbeverages by the package or drink, fifty dollars ($50) per day; and\n2. Distillers, wineries, and brewers for violations arising from their retail\nsales activities, including sales by distillers under licenses issued\npursuant to KRS 243.086 and sales at retail under KRS 243.0305, fifty\ndollars ($50) per day;\n(c) Cannabis-infused beverage retail package licenses, fifty dollars ($50) per day;\nand\n(d) All remaining licensees, fifty dollars ($50) per day.\n(2) Payments in lieu of suspension or for board -ordered agency server training,\ncollected on a cost recovery basis, collected by  the Alcoholic Beverage Control\nBoard shall be deposited in the State Treasury and credited to the general\nexpenditure fund. Payments in lieu of suspension collected by local administrators\nshall be deposited and used as local alcoholic beverage license ta x receipts are\ndeposited and used.\n(3) In addition to or in lieu of a suspension of a license, the board may order a licensee\nto pay for and require attendance and completion by some or all of the licensee's\nalcoholic beverage servers in the department's server training program.\n(4) Appeals from orders of suspension and the procedure thereon shall be the same as\nare provided for orders of revocation in KRS Chapter 13B.\n(5) The portions of this section relating to local administrators shall not apply to\ncannabis-infused beverage licensees.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55938","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:54Z","sha256":"a4cce4e37e778cb19c42814fb171c24a22b090aef822a9cc0934aeab50e447bd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.470","next":"us-ky/krs-243.490"},"notice":"GroundRules: Original legal text.
