{"data":{"id":"us-ky/krs-244.080","jurisdiction":"us-ky","citation":"KRS 244.080","heading":"Retail sales to certain persons prohibited -- Affirmative defense in","body":"prosecution for selling to a minor.\nA retail licensee, or the licensee's agent, servant, or employee, shall not sell, give away,\nor deliver any alcoholic beverages or cannabis -infused beverages, or procure or permit\nany alcoholic beverages or cannabis -infused beverages to be sold, given away, possessed\nby, or delivered to:\n(1) A minor, except that in any prosecution for selling alcoholic beverages or cannabis -\ninfused beverages to a minor it shall be an affirmative defense that the sale was\ninduced by the use of false, fraudulent, or altered identification papers or other\ndocuments and that the appearance and character of the purchaser were such that\nthe purchaser's age could not have been ascertained by any other means and that the\npurchaser's appearance and character indicated strongly that the purchaser was of\nlegal age to purchase alcoholic beverages or cannabis -infused beverages. This\nevidence may be introduced either in miti gation of the charge or as a defense to the\ncharge itself; or\n(2) A person who appears to a reasonable person to be actually or apparently under the\ninfluence of alcoholic beverages, cannabis -infused beverages, controlled\nsubstances, other intoxicating sub stances, or any of these substances in\ncombination, to the degree that the person may endanger any person or property, or\nunreasonably annoy persons in the vicinity.","path":["KRS Chapter 244"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55942","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:54Z","sha256":"6c29187caa0e58d7b05fe179d2f5277c440c2b4e4c54776b1fc0305f7d2d26b8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-244.070","next":"us-ky/krs-244.083"},"notice":"GroundRules: Original legal text.
