{"data":{"id":"us-ky/krs-244.085","jurisdiction":"us-ky","citation":"KRS 244.085","heading":"Minors not to possess or purchase liquor nor to misrepresent age -- Use of","body":"fraudulent identification -- Prohibition against minors remaining on premises\nwhere alcoholic beverages sold.\n(1) A person under twenty -one (21) years of age shall n ot enter any premises licensed\nfor the sale of alcoholic beverages for the purpose of purchasing or receiving any\nalcoholic beverages.\n(2) A person under twenty -one (21) years of age shall not possess for personal use or\npurchase or attempt to purchase or have another purchase for the person any\nalcoholic beverages. No person shall aid or assist any person under twenty -one (21)\nyears of age in purchasing or being delivered or served any alcoholic beverages.\n(3) A person under twenty-one (21) years of age shall not misrepresent the person's age\nfor the purpose of inducing any licensee, or the licensee's agent, servant, or\nemployee, to sell or serve any alcoholic beverages to the underage person.\n(4) A person under twenty -one (21) years of age shall not use, o r attempt to use any\nfalse, fraudulent, or altered identification card, paper, or any other document to\npurchase or attempt to purchase or otherwise obtain any alcoholic beverage.\n(5) Except as provided in KRS 244.090, a licensee, or the licensee's agents,  servants, or\nemployees shall not permit any person under twenty-one (21) years of age to remain\non any premises where alcoholic beverages are sold by the drink or consumed on\nthe premises, unless:\n(a) The usual and customary business of the licensee is a hotel, motel, restaurant,\nconvention center, convention hotel complex, racetrack, simulcast facility,\ngolf course, private club, park, fair, church, school, athletic complex, athletic\narena, theater, small farm winery, distillery, brewery, winery, convenie nce\nstore, grocery store, drug store, entertainment destination center, licensed APC\npremises, live music or other entertainment or public facility, or any other\nbusiness type, as determined by the board through the promulgation of\nadministrative regulatio ns, whose operations allow it to adequately monitor\nand prevent alcohol sales to minors; or\n(b) All alcoholic beverage inventory is kept in a separate, locked department at all\ntimes when minors are on the premises.\n(6) Except as provided in subsection (5)  of this section, a licensee or the licensee's\nagent, servant, or employee shall not allow any person under the age of twenty -one\n(21) to remain on any premises that sells alcoholic beverages by the package unless\nthe underage person is accompanied by a pa rent or guardian or the usual and\ncustomary business of the establishment is a convenience store, grocery store,\ndrugstore, or similar establishment.\n(7) Except as provided in subsection (5) of this section, a person under the age of\ntwenty-one (21) shall not remain on any premises that sells alcoholic beverages by\nthe package unless the person under the age of twenty-one (21) is accompanied by a\nparent or guardian or the usual and customary business of the establishment is a\nconvenience store, grocery store, drugstore, or similar establishment.\n(8) A violation of subsection (1), (2), (3), (4), or (7) of this section shall be deemed a\nstatus offense if committed by a person under the age of eighteen (18) and shall be\nunder the jurisdiction of the juvenile se ssion of the District Court or the family\ndivision of the Circuit Court, as appropriate.","path":["KRS Chapter 244"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50405","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:54Z","sha256":"2a680b5182c2784340d67334372629a985209e3a8b8ad47ab30f3efdcb17b6ba","source_id":"us-ky","stale":false,"prev":"us-ky/krs-244.083","next":"us-ky/krs-244.087"},"notice":"GroundRules: Original legal text.
