{"data":{"id":"us-ky/krs-244.125","jurisdiction":"us-ky","citation":"KRS 244.125","heading":"Prohibition against possession of loaded firearm in room where alcoholic","body":"beverages are being sold by the drink.\n(1) Except as provided in subsection (3) of this section, no person shall be in\npossession of a loaded, as defined in KRS 237.060, firearm while actually within\nthe room where alcoholic beverages are being sold by the drink of a building on\npremises licensed to sell distilled spirits and wine at retail by the drink for\nconsumption on the licensed premises pursuant to KRS Chapter 243.\n(2) This section shall not apply to the owner manager, or employee of licensed\npremises, law enforcement officers, or special local peace officers commissioned\npursuant to KRS 61.360.\n(3) This section shall not apply to a bona fide restaurant open to the general p ublic\nhaving dining facilities for not less than fifty (50) persons and which receives less\nthan fifty percent (50%) of its annual food and beverage receipts from the dining\nfacilities by the sale of alcohol.\n(4) Nothing in this section shall be construed as permitting the carrying of a concealed\ndeadly weapon in violation of KRS 527.020.\n(5) Any firearm possessed in violation of this section shall be subject to forfeiture and\nshall be disposed of pursuant to KRS 237.090.","path":["KRS Chapter 244"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43043","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:54Z","sha256":"a6e3e5965877e76ead53922cd5dda1098516fe16244906bdbd43359015b016a7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-244.120","next":"us-ky/krs-244.130"},"notice":"GroundRules: Original legal text.
