{"data":{"id":"us-ky/krs-244.167","jurisdiction":"us-ky","citation":"KRS 244.167","heading":"Unlawful acts relating to wholesalers or distributors.","body":"(1) It is unlawful:\n(a) For any distiller, rectifier, winery, brewer, or importer to solicit, accept, or\nfill any order for any alcoholic beverage from any wholesaler or distributor\nin the Commonwealth  of Kentucky unless the supplier is the primary\nsource of supply for the brand of alcoholic beverage sold or sought to be\nsold;\n(b) For  any  wholesaler, distributor, or  any  other licensee in this\nCommonwealth  to order, purchase, or receive any alcoholic beverage\nfrom any supplier unless the supplier is the primary source of supply for\nthe brand ordered, purchased, or received;\n(c) For a retailer to order, purchase, or receive any alcoholic beverage from\nany source other than any of the following:\n1. A  wholesaler or distributor who has purchased the brand from the\nprimary source of supply; or\n2. A  wholesaler or distributor who is the designated representative of\nthe primary source of supply in this Commonwealth  and who has\npurchased alcoholic beverages from the designated representative\nof  the  primary  source  of  supply  within or  without this\nCommonwealth;  and\n(d) For  alcoholic beverages to be  transported from a wholesaler's or\ndistributor's warehouse within twenty-four (24) hours of the time they are\nunloaded.\n(2) The Alcoholic Beverage Control Board may suspend for a period not to exceed\none (1) year the license of any wholesaler, distributor, or retailer who violates\nthe provisions of this section.\n(3) Upon  determination by the Alcoholic Beverage Control Board that a primary\nsource of supply has violated the provisions of this section, no wholesaler,\ndistributor, or retailer may accept any shipment of alcoholic beverages from the\nprimary source of supply for a period of one (1) year.","path":["KRS Chapter 244"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45994","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:55Z","sha256":"430e614052a362b9eed49e11f9270262f746643cf4290db8303903ee1094697d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-244.165","next":"us-ky/krs-244.170"},"notice":"GroundRules: Original legal text.
