{"data":{"id":"us-ky/krs-244.240","jurisdiction":"us-ky","citation":"KRS 244.240","heading":"Distiller, rectifier, winery, or wholesaler not to be interested in retail","body":"premises  -- Transactions prohibited -- Discounts in the usual course of\nbusiness  -- Retailer not to demand  violation of this section -- Permitted\nactivities.\n(1) No  distiller, rectifier, winery, or wholesaler and no employee, servant, or agent\nof a distiller, rectifier, winery, or wholesaler shall:\n(a) Except as provided in KRS  243.0305 and 243.155, be interested directly\nor indirectly in any way in any premises where distilled spirits or wine is\nsold at retail or in any business devoted wholly or partially to the sale of\ndistilled spirits or wine at retail;\n(b) Make  or cause to be made  any loan to any person engaged  in the\nmanufacture or sale of distilled spirits or wine at wholesale or retail;\n(c) Make  any gift or render any kind of service whatsoever, directly or\nindirectly, to any licensee that may  tend to influence the licensee to\npurchase the product of the distiller, rectifier, winery, or wholesaler; or\n(d) Enter into a contract with any retail licensee under which the licensee\nagrees  to confine the licensee's sales to distilled spirits or wine\nmanufactured or sold by one (1) or more distillers, rectifiers, wineries, or\nwholesalers. This type of contract shall be void.\n(2) Nothing in this section shall prohibit the giving of discounts in the usual course\nof business if the same discounts are offered to all licensees holding the same\nlicense type buying similar quantities.\n(3) A  retailer shall not require or demand  that a distiller, rectifier, winery, or\nwholesaler violate this section.\n(4) This section shall not prohibit a distiller from:\n(a) Supplying a retailer with barrels for the purpose of holding barrel-aged\nand batched cocktails; and\n(b) Selling private selection packages as authorized in KRS 243.0305(4)(a)3.","path":["KRS Chapter 244"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52071","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:55Z","sha256":"3541e04d3ad567bb27532cbf61e6f99d6adf30bd853e498f4cbdf1fbfd173b3f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-244.235","next":"us-ky/krs-244.245"},"notice":"GroundRules: Original legal text.
