{"data":{"id":"us-ky/krs-244.480","jurisdiction":"us-ky","citation":"KRS 244.480","heading":"Sales of malt beverages when polls are open permitted in wet or moist","body":"territory -- Power of local governments to regulate -- Sunday sales.\n(1) Except as permitted by subsection (4) of this section, no brewer or distributor shall\ndeliver any malt beverages on Sunday or between the hours of midnight and 6 a.m.\non any other day.\n(2) Except as permitted by subsection (4) of this section, a licensee authorized to sell\nmalt beverages at retail shall not sell, give away, or deliver any malt beverag es\nbetween midnight and 6 a.m. or at any time during the twenty -four (24) hours of a\nSunday.\n(3) (a) A licensee authorized to sell malt beverages at retail may sell malt beverages\nduring the hours the polls are open on a primary, or regular, local option, or\nspecial election day unless the licensee is located where the legislative body\nof an urban -county government, consolidated local government, charter\ncounty government, unified local government, city, or county, in which traffic\nin malt beverages is perm itted by KRS Chapter 242 has adopted an ordinance\nafter June 25, 2013, that prohibits the sale of alcoholic beverages or limits the\nhours and times in which alcoholic beverages may be sold within its\njurisdictional boundaries on any primary, or regular, lo cal option, or special\nelection day.\n(b) This subsection shall only apply in a wet or moist territory.\n(c) Notwithstanding any other provisions of the Kentucky Revised Statutes to the\ncontrary, the fiscal court of a county shall not by ordinance or any oth er\nmeans:\n1. Supersede, reverse, or modify any decision made pursuant to this\nsubsection by the legislative body of a city within that county; or\n2. Impose an action upon a city within that county when that city has taken\nno formal action pursuant to this subsection.\n(4) (a) A licensee may sell or deliver malt beverages on Sunday and during the times\nand hours as permitted by a local ordinance of the legislative body of an\nurban-county government, consolidated local government, charter county\ngovernment, unified local governme nt, city, or county with local jurisdiction.\nThe ordinance shall not prohibit the sale, gift, or delivery of any malt\nbeverages between 6 a.m. and midnight during any day, except Sunday.\n(b) A licensee authorized to sell malt beverages by the drink at reta il may sell\nmalt beverages by the drink on Sunday and during the times and hours as\npermitted by a local ordinance of the legislative body of an urban -county\ngovernment, consolidated local government, charter county government,\nunified local government, ci ty, or county with local jurisdiction.
