{"data":{"id":"us-ky/krs-244.992","jurisdiction":"us-ky","citation":"KRS 244.992","heading":"Medical amnesty for persons reporting an alcohol overdose.","body":"(1) A person shall be immune from prosecution for the criminal offenses identified in\nsubsection (2) of this section if:\n(a) A law enforcement officer has contact with the person because the person:\n1. Requests emergency medical assistance for himself or herse lf or another\nperson;\n2. Acts in concert with another person who requests emergency medical\nassistance; or\n3. Appears to be in need of emergency medical assistance and is the\nindividual for whom the request is made;\n(b) The request is made for an individual who reasonably appears to be in need of\nmedical assistance due to alcohol consumption; and\n(c) The person described in paragraph (a) of this subsection, if physically capable:\n1. Provides his or her own full name if requested by emergency medical\nassistance personnel or law enforcement officers;\n2. Provides any other relevant information requested by the law\nenforcement officer that is known to such person;\n3. Remains with, or is, the individual who reasonably appears to be in need\nof medical assistance d ue to alcohol consumption until professional\nemergency medical assistance is provided; and\n4. Cooperates with emergency medical assistance personnel and law\nenforcement officers.\n(2) A person who meets the qualifications set forth in subsection (1) of this  section\nshall be immune from criminal prosecution for the following offenses:\n(a) Alcohol intoxication under KRS 222.202(1);\n(b) Drinking alcoholic beverages in a public place under KRS 222.202(2);\n(c) Offenses related to possession of alcoholic beverages by a minor under\ntwenty-one (21) years of age under KRS 244.085; and\n(d) Providing alcohol to minors under twenty -one (21) years of age or assisting\nminors under twenty -one (21) years of age to purchase  alcohol under KRS\n244.085 or 530.070.","path":["KRS Chapter 244"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42516","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:55Z","sha256":"659ca7fea6a1be56f56d354b5955718b236bfa9473915f175b1397908ca91ce1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-244.990","next":"us-ky/krs-246.010"},"notice":"GroundRules: Original legal text.
