{"data":{"id":"us-ky/krs-247.090","jurisdiction":"us-ky","citation":"KRS 247.090","heading":"State Fair Board -- Membership  -- Vacancies -- State Fair Board not","body":"subject to reorganization under KRS  Chapter 12.\n(1) The State Fair Board shall be composed  of sixteen (16) voting members  and\nfive (5) ex officio, nonvoting members, as follows:\n(a) The Governor or his or her designee;\n(b) The Commissioner of Agriculture or his or her designee;\n(c) The President of the Senate or his or her designee, who shall serve as an\nex officio, nonvoting member  for the duration of his or her service as\nPresident of the Senate;\n(d) The Speaker of the House of Representatives or his or her designee, who\nshall serve as an ex officio, nonvoting member  for the duration of his or\nher service as Speaker of the House of Representatives;\n(e) The  secretary of the Finance and Administration Cabinet or his or her\ndesignee, who shall serve as an ex officio, nonvoting member  for the\nduration of his or her service as secretary of the cabinet. The secretary\nshall provide additional financial expertise to the Kentucky State Fair\nBoard, with no resulting personnel impact, fiscal impact, nor expense to\nKentucky state government;\n(f) The dean of the University of Kentucky College of Agriculture, Food and\nEnvironment or his or her designee;\n(g) Four (4) members  appointed by the Governor from the state at large with\ndue consideration to geographical distribution throughout the state;\n(h) Three (3) members  appointed by the Commissioner of Agriculture from\nthe state at large who are involved with, or experienced in, agriculture or\nagriculture-related businesses;\n(i) One  (1) member  appointed by the Commissioner of Agriculture from a list\nof six (6) nominees that are representative of all segments of animal\nagriculture provided by trade organizations and commodity groups that\nmay  include but not be limited to the Kentucky Cattlemen's Association,\nKentucky Dairy Development Council, Kentucky Livestock Improvement\nAssociation, Kentucky Pork Producers Association, Kentucky Poultry\nFederation, and Kentucky Sheep and Goat Development Office;\n(j) One  (1) member  appointed by the Commissioner of Agriculture from a list\nof six (6) nominees that are representative of all segments of crop or plant\nproduction provided by trade organizations or commodity groups that may\ninclude but not be  limited to Kentucky Corn  Growers  Association,\nKentucky  Grape  and  Wine  Council, Kentucky Horticulture Council,\nKentucky  Small Grain Growers  Association, and  Kentucky Soybean\nAssociation;\n(k) One  (1) member  appointed by the Commissioner of Agriculture from a list\nof six (6) nominees submitted by the governing body of the American\nSaddlebred Horse Association;\n(l) One  (1) member  appointed by the Commissioner of Agriculture from a list\nof six (6) nominees provided by the Kentucky Farm Bureau Federation;\n(m) One  (1) member  appointed by the Commissioner of Agriculture from a list\nof six (6) nominees provided by the Kentucky Association of Fairs and\nHorse Shows;\n(n) One  (1) member  appointed by the Governor from a list of six (6)\nnominees  provided by the Louisville Convention and Visitors Bureau\nrepresenting the hospitality and tourism industry;\n(o) The state president of the Kentucky FFA Association, who shall serve as\nan ex officio, nonvoting member  for the duration of his or her term as\nstudent leader of the association; and\n(p) The state president of the Kentucky 4-H Organization, who shall serve as\nan ex officio, nonvoting member  for the duration of his or her term as\nstudent leader of the organization.\n(2) The  terms of the members  of the board appointed by the Commissioner of\nAgriculture or the Governor, respectively, shall be staggered terms and shall be\nsubject to confirmation as provided in KRS  11.160(2). Members  of the board\nshall be appointed to a term of four (4) years and shall serve until their\nsuccessors are duly appointed and qualified. Members  of the board shall be\nappointed to no more than three (3) terms that began on or after March 29,\n2021. Terms that began prior to March 29, 2021, shall not count toward the\nterm limits established by this subsection. As the terms of each group of\nmembers  expire, the Commissioner of Agriculture or the Governor, as the case\nmay  be, shall appoint successors for terms of four (4) years and until their\nsuccessors are appointed and qualify. The initial appointments of the members\ndesignated in subsection (1)(g) and (h) of this section shall be for staggered\nterms, as follows:\n(a) Pursuant to subsection (1)(g) of this section, the Governor shall appoint\none (1) at-large member  in 2022, one (1) at-large member  in 2023, and\ntwo  (2) at-large members  in 2024  to replace or reappoint current\nmembers  whose terms expire in each of these years;\n(b) Pursuant  to subsection 1(h) of this section, the Commissioner  of\nAgriculture shall appoint one (1) at-large member  in 2021, one (1) at-large\nmember  in 2022, and one (1) at-large member  in 2023 to replace or\nreappoint current members  whose terms expire in each of these years;\n(c) On  March 29, 2021, and pursuant to subsection (1)(h) of this section, the\nCommissioner  of Agriculture shall appoint one (1) at-large member  to\nserve a one (1) year term in order to establish the number  of voting\nmembers  as required by this section; and\n(d) Those  members  whose terms expire in 2021 shall be appointed by the\nCommissioner of Agriculture.\nIt is the intention of the General Assembly that the political affiliation of the\nappointed members  shall be as evenly divided as possible between the two (2)\npolitical parties polling the largest number  of votes in the state at general\nelections.\n(3) In case of a vacancy among  the appointed members  of the board, the\nunexpired term shall be filled pursuant to the requirements and procedures for\noriginal appointments.\n(4) The State Fair Board shall not be subject to reorganization under KRS  Chapter\n12.","path":["KRS Chapter 247"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50763","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:56Z","sha256":"a4093bb7548d2cffc91048a351d69f63104cf5e0ad763b6a351ed584b0ed1651","source_id":"us-ky","stale":false,"prev":"us-ky/krs-247.088","next":"us-ky/krs-247.100"},"notice":"GroundRules: Original legal text.
