Any mechanized device or combination of devices which carry\npassengers along, around, or over a fixed or restricted course for the\npurpose of giving its passengers amusemen t, pleasure, thrills, or\nexcitement; or\n2. Any building or structure around, over, or through which people may\nwalk, climb, slide, jump, or move that provides amusement, pleasure,\nthrills, or excitement.\n(b) Unless designated by administrative regulation p romulgated by the\ndepartment, \"amusement ride or attraction\" does not include:\n1. Coin-operated amusement devices;\n2. Devices regulated by the Federal Aviation Administration, the Kentucky\nTransportation Cabinet, or the federal railroad commission;\n3. Vessels under the jurisdiction of the United States Coast Guard or the\nKentucky Department of Fish and Wildlife Resources;\n4. Tractor pulls;\n5. Auto or motorcycle events;\n6. Horse shows, rodeos, and other animal shows;\n7. Games and concessions; or\n8. Nonmechanical playground equipment, such as swings, seesaws, slides\nless than fifteen (15) feet in height at their highest point, rider -propelled\nmerry-go-rounds, stationary spring -mounted animal devices, and\nphysical fitness equipment.\nThe department may , by administrative regulation, designate other rides and\nattractions that are not included in the definition of \"amusement ride or attraction\";\n(2) \"ASTM Standard\" means the latest standards and specifications as set forth by the\nAmerican Society for Testing and Materials;\n(3) \"Department\" means the Kentucky Department of Agriculture;\n(4) \"Operator\" means a person sixteen (16) years of age or older who has been properly\ntrained to operate amusement rides and attractions, has knowledge of the\nmanufacturer's recommendations for the operation of the rides and attractions, and\nknows the safety-based limitations of the rides and attractions; and\n(5) \"Owner\" means any person or authorized agent of the person who owns an\namusement ride or attraction or, in the eve nt the ride or attraction is leased, the\nlessee.","path":["KRS Chapter 247"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52710","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:57Z","sha256":"8ccbcee98b3b404fe26aac4ca2d2df8ee765fef3f82e3feda1b1780559c22d57","source_id":"us-ky","stale":false,"prev":"us-ky/krs-247.230","next":"us-ky/krs-247.233"},"notice":"GroundRules: Original legal text.
