{"data":{"id":"us-ky/krs-247.233","jurisdiction":"us-ky","citation":"KRS 247.233","heading":"Occurrence involving amusement ride or attraction resulting in death,","body":"certain injuries, or damage affecting future safe operation -- Investigation --\nAdministrative violations and civil penalties.\n(1) The owner of any amusement ride or at traction shall, within twelve (12) hours,\nnotify the department of any occurrence involving an amusement ride or attraction\nif the occurrence results in:\n(a) Death;\n(b) Injury to a person, where:\n1. The owner knows or reasonably should know that the injury  was caused\nby the amusement ride or attraction; and\n2. The owner knows or reasonably should know that the injury required\nmedical treatment other than first aid; or\n(c) Damage to an amusement ride or attraction that affects the future safe\noperation of th e ride or attraction. Reporting is not required in the case of\nnormal wear and tear.\n(2) The department shall, after notification of an occurrence described in subsection (1)\nof this section, make a complete and thorough investigation of the occurrence. Th e\nreport of the investigation shall be placed on file in the department and shall give in\ndetail all facts and information available. The owner may submit results of\ninvestigations independent of the department's investigation for inclusion in the file.\n(3) No person, following an occurrence described in subsection (1) of this section,\nshall:\n(a) Operate or move the amusement ride or attraction without the approval of the\ndepartment, unless necessary to prevent injury to a person; or\n(b) Remove from the premises any damaged or undamaged part of the amusement\nride or attraction or attempt to repair any damaged part before the department\nhas completed its investigation. The department shall initiate its investigation\nwithin twelve (12) hours of being notified.\n(4) The department may:\n(a) Conduct hearings;\n(b) Administratively subpoena and examine under oath persons whose activities\nare subject to KRS 247.232 to 247.236;\n(c) Issue administrative subpoenas and examine the business records, books, and\naccounts of persons whose activities are subject to KRS 247.232 to 247.236;\nand\n(d) Request any other information necessary to assist the department in properly\nperforming the department's duties.\n(5) The department shall have control of any incident scene involving an amusement\nride or attraction if there has been an occurrence described in subsection (1) of this\nsection. The department shall remain in control of the scene until th e department\ncompletes its investigation and releases the scene. The department shall have access\nwithin twelve (12) hours to all documents or records pertaining to the amusement\nride or attraction.\n(6) (a) The department shall promulgate administrative re gulations relating to\namusement rides and attractions that establish:\n1. A comprehensive set of administrative violations and civil penalties not\nto exceed ten thousand dollars ($10,000); and\n2. The procedure for the suspension or revocation of any busines s\nidentification number, license, or other certificate issued by the\ndepartment.\n(b) No owner of an amusement ride or attraction shall remove the amusement ride\nor attraction from the state before paying all civil penalties imposed under this\nsubsection.","path":["KRS Chapter 247"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52711","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:57Z","sha256":"7c7f1ca27cf692a02eaf868c38c20c2f1fbec23ff301c67f93e4bb104ae3a447","source_id":"us-ky","stale":false,"prev":"us-ky/krs-247.232","next":"us-ky/krs-247.234"},"notice":"GroundRules: Original legal text.
