{"data":{"id":"us-ky/krs-247.235","jurisdiction":"us-ky","citation":"KRS 247.235","heading":"Temporary amusement rides and attractions -- License required --","body":"Sanctions.\n(1) (a) Every person that operates a for -profit business that provides temporary\namusement rides or amusement attractions that are within the same county as,\nor are within a five (5) mile radius of, a public fair or exposition that is\nsanctioned by the De partment of Agriculture and is operated by a public fair\nassociation shall, before beginning operation, pay a license fee of two\nthousand dollars ($2,000) per day of operation to the fiscal court of the county\nin which the temporary amusement rides or amusement attractions are located.\n(b) The provisions of paragraph (a) of this subsection shall not apply to temporary\namusement rides or amusement attractions that:\n1. Operate in connection with the sanctioned public fair or exposition;\n2. Operate at a public  fair or exposition that is in a contiguous county, is\nsanctioned by the Department of Agriculture, and is under the authority\nof a public fair association;\n3. Operate under the authority of a religious or educational organization;\n4. Operate more than thi rty (30) days before or seven (7) days after the\nsanctioned public fair or exposition;\n5. Are clown acts, local festivals, or amusement or entertainment shows\nwith six (6) or fewer kiddie rides; or\n6. Operated as a nonprofit or charitable organization in t his state before\nMarch 10, 2003.\n(2) Collection and enforcement for payment of the license fee shall be the sole\nresponsibility of the law enforcement entity acting on behalf of and at the direction\nof the fiscal court in which the temporary amusement ride s or amusement\nattractions are located.\n(3) Failure to pay the license fee upon request of the law enforcement entity shall result\nin the cessation of operation of the amusement rides or amusement attractions by\nthe operator.","path":["KRS Chapter 247"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11612","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:57Z","sha256":"4987f36b1d96387f515c68a4617cc04846ef8faeafb1c435227720b2607c7808","source_id":"us-ky","stale":false,"prev":"us-ky/krs-247.234","next":"us-ky/krs-247.2351"},"notice":"GroundRules: Original legal text.
