{"data":{"id":"us-ky/krs-247.236","jurisdiction":"us-ky","citation":"KRS 247.236","heading":"Operation and construction of amusement rides and attractions --","body":"Prohibitions on operation -- Entrance to amusement ride or attraction may be\ndenied.\n(1) Amusement rides and attractions shall not be operated at unsafe speeds or loaded\nbeyond a safe capacity in accordance with the factory specifications or, in the\nabsence of factory specifications, in accordance with administrative regulations\npromulgated by the department.\n(2) Amusement rides and attractions shall not be operated during peri ods of high wind,\nlightning, or heavy rain.\n(3) Perimeter safety barriers such as a fence or other suitable structure shall be\nconstructed around any amusement ride or attraction that is potentially hazardous to\nbystanders, in accordance with administrativ e regulations promulgated by the\ndepartment.\n(4) Amusement rides and attractions shall not be operated if the owner or operator\nknows or should know that the operation will expose the public to an unsafe\ncondition which is likely to result in personal injury or property damage.\n(5) (a) No person under the age of sixteen (16) shall operate an amusement ride or\nattraction or operate more than one (1) ride or attraction at a time. Except as\nprovided by paragraph (c) of this subsection, an operator shall be in\nattendance at all times while a ride or attraction is in operation.\n(b) No person shall operate an amusement ride or attraction or knowingly permit\nan operator to operate an amusement ride or attraction while under the\ninfluence of alcohol or any other impairing substance.\n(c) The department may, by administrative regulation, designate certain\namusement rides or attractions where the presence of an operator is not\nrequired.\n(6) The owner or operator may deny any person entrance to an amusement ride or\nattraction if the owner or operator has reason to believe the entry may jeopardize the\nsafety of the person desiring entry, other riders, or any other person.","path":["KRS Chapter 247"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52713","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:57Z","sha256":"c5403dd7e6dc514dac397a3fe4eef694335e12bf2b0b8765a4b07a6f66e0610e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-247.2353","next":"us-ky/krs-247.238"},"notice":"GroundRules: Original legal text.
