{"data":{"id":"us-ky/krs-247.4027","jurisdiction":"us-ky","citation":"KRS 247.4027","heading":"Warning signs and notices -- Waiver -- Effect of noncompliance --","body":"Exclusions.\n(1) Every farm animal activity sponsor and every farm animal professional shall post\nand maintain signs which contain the warning notice specified in subsection (3) of\nthis section. Signs shall be placed in a clearly visible location on or near stables,\ncorrals, or areas where the farm animal professional or the farm animal activity\nsponsor conducts farm animal activities. The warning notice specified in subsection\n(3) of th is section shall appear on the sign in black letters, with each letter to be a\nminimum of one (1) inch in height.\n(2) Every written contract entered into by a farm animal professional or by a farm\nanimal activity sponsor for the providing of professional services, instruction, or the\nrental of equipment or tack or a farm animal to a participant, whether the contract\ninvolves farm animal activities on or off the location or site of the farm animal\nprofessional's or the farm animal activity sponsor's business , shall contain in clearly\nreadable print the warning notice specified in subsection (3) of this section.\n(a) If a participant or parent or guardian of a minor prior to participation in a farm\nanimal activity knowingly signs a contract containing the warni ng set forth in\nsubsection (3) of this section, the contract shall be deemed a waiver of the\nright to bring an action against the farm animal professional or farm animal\nactivity sponsor for any injury, damage, loss, or death arising out of any farm\nanimal activity. The waiver shall be binding upon the participant, except as\nregards acts of negligence by a farm animal professional, a farm animal\nactivity sponsor, or any other person covered in KRS 247.402(2).\n(b) The waiver shall remain valid unless express ly revoked in writing by the\nparticipant or parent or guardian of a minor. In the case of school and college\nsponsored classes and programs, waivers executed by a participant or parent\nor guardian of a participant shall apply to all farm animal activities in which\nthe participant is involved in the next succeeding twelve (12) month period\nunless earlier expressly revoked in writing.\n(3) The signs and contracts described in subsections (1) and (2) of this section shall\ncontain the following warning notice:\n\"WARNING\nUnder Kentucky law, a farm animal activity sponsor, farm animal professional, or other\nperson does not have the duty to eliminate all risks of injury of participation in farm\nanimal activities. There are inherent risks of injury that you volu ntarily accept if you\nparticipate in farm animal activities.\"\n(4) Failure to comply with the requirements concerning warning signs and notices\nprovided in this section shall prevent a farm animal activity sponsor or farm animal\nprofessional from invoking the provisions of KRS 247.401 to 247.4029.\n(5) Nothing in KRS 247.401 to 247.4029 shall create a duty for a farm animal activity\nsponsor, farm animal professional, or other person to give a warning to a participant\nengaged in a farm animal activity with his  own farm animal, or to a participant\nwhom the farm animal activity sponsor, farm animal professional, or other person\nknows to possess reasonable knowledge of or experience with the inherent risk of\nfarm animal activities, or who has represented to the fa rm animal activity sponsor,\nfarm animal professional, or other person that he possesses reasonable knowledge\nor experience with the inherent risks of farm animal activities.","path":["KRS Chapter 247"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11639","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:57Z","sha256":"a45b4cc9dc2074f66172605e5d4150a01d9103e44cb3d64cb6051b0aa9439e88","source_id":"us-ky","stale":false,"prev":"us-ky/krs-247.4025","next":"us-ky/krs-247.4029"},"notice":"GroundRules: Original legal text.
