{"data":{"id":"us-ky/krs-247.4481","jurisdiction":"us-ky","citation":"KRS 247.4481","heading":"Annual review of assessment program -- Termination by referendum --","body":"Termination by request of certified operating agency.\n(1) The board shall review the assessment program annually. If, at the end of each year\nafter the first year of the assessment p rogram, the board determines that twenty-five\npercent (25%) of the producers are not participating in the program, the\nCommissioner shall then conduct a referendum among the producers. If, upon the\nreferendum, a majority of the producers eligible to partic ipate and voting therein\nreject the program, it shall be terminated as at the end of the month in which the\nreferendum was conducted and held; otherwise the assessment program shall\ncontinue in force and effect.\n(2) If the certified commission, council, bo ard, association, or other agency of\nproducers expresses in writing its desire to the Commissioner to discontinue the\nassessment program and terminate the assessment, the Commissioner shall within\nfifteen (15) days following receipt of the request convene the board to review and\nact on the request. The board, after reviewing the request and conducting whatever\nproceedings are deemed appropriate and necessary in connection with the request,\nmay terminate the program effective at the end of the month in which  the board\naction is taken; and in this event the Commissioner shall notify, by certified mail,\nthe purchasers of the agricultural commodity of the termination of the program.","path":["KRS Chapter 247"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11669","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:57Z","sha256":"6b21dec825e0e6a4863d2609dd00654dd08dca721603d94a21adafb70a4fc818","source_id":"us-ky","stale":false,"prev":"us-ky/krs-247.4479","next":"us-ky/krs-247.4483"},"notice":"GroundRules: Original legal text.
