{"data":{"id":"us-ky/krs-247.5093","jurisdiction":"us-ky","citation":"KRS 247.5093","heading":"Procedures to terminate assessment.","body":"(1) The question of the levy of the assessment on small grains may be referred to a vote\nof the small grains producers of the state by filing petitions with the certified\nassociation containing signatures of Kentucky small grains producers equal in\nnumber to ten percent (10%) of all small grains producers in the state as recorded in\nthe latest United States Census of Agriculture. If after the petitions are filed and at\nthe referendum election a majority of Kentucky small grains producers voting on\nthe question vote against the levy on small grains, the assessment shall be\nterminated at the end of the marketing year in which the referendum was conducted;\notherwise, the assessment program shall continue.\n(2) If the duly certified association of small grains produc ers expresses in writing its\ndesire to the Commissioner to discontinue the assessment program and terminate\nthe program, the Commissioner shall within fifteen (15) days following receipt of\nthe request convene the board to review and act on the request. Th e board, after\nreviewing the request and conducting whatever proceedings are deemed appropriate\nand necessary in connection with the request, may terminate the program effective\nat the end of the marketing year in which the board action is taken; and, in t his\nevent, the Commissioner shall notify, by certified mail, the purchasers of small\ngrains affected thereby of the termination of the program.","path":["KRS Chapter 247"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11704","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:58Z","sha256":"e1c96c9e2a3c83a3ab3a6abd9b4993b46e120378252634ca652a34f38e58bc55","source_id":"us-ky","stale":false,"prev":"us-ky/krs-247.5091","next":"us-ky/krs-247.5095"},"notice":"GroundRules: Original legal text.
