If, at the end of each\nmarketing year after the first marketing year of the assessment program, the board\ndetermines that twenty percent (20%) of the producers assessed have indicated their\ndissatisfaction with the program by demanding a refund of the assessment collected\nfrom them, the Commissioner shall conduct a referendum among the producers. If,\nupon the referendum, a majority of the eligible producers who vote in the\nreferendum reject the program , it shall be terminated at the end of the marketing\nyear in which the referendum was conducted; otherwise, the assessment program\nshall continue.\n(2) If the duly certified association of ovine and caprine animal producers expresses in\nwriting its desire t o the Commissioner to discontinue the assessment program and\nterminate the program, the Commissioner shall within fifteen (15) days following\nreceipt of the request convene the board to review and act on the request. The board,\nafter reviewing the request and conducting whatever proceedings are deemed\nappropriate and necessary in connection with the request, may terminate the\nprogram effective at the end of the marketing year in which the board action is\ntaken; and, in this event, the Commissioner shall not ify, by certified mail, the\npurchasers of ovine and caprine animals affected by the termination of the program.","path":["KRS Chapter 247"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11796","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:59Z","sha256":"5f14a4d3ec1b1aeb84eeec411d9624887ac5be92905abaeb85b815cd66594915","source_id":"us-ky","stale":false,"prev":"us-ky/krs-247.6951","next":"us-ky/krs-247.6957"},"notice":"GroundRules: Original legal text.
