{"data":{"id":"us-ky/krs-247.864","jurisdiction":"us-ky","citation":"KRS 247.864","heading":"Annual review of assessment program -- Termination of program.","body":"(1) The board shall review the assessment program annually. If, at the end of each year\nafter the first year of the assessment program, the board determines that there is\ndissatisfaction with the program, the Commissioner shall then conduct a referendum\namong the handlers in the area. If upon the referendum, a majority of the handlers\nvoting in the area reject the program, it shall be terminated at the end of the year in\nwhich the referendum for the area was conducted; otherwise, the assessment\nprogram shall continue in force and effect.\n(2) If the duly certified association expresses in writing its desire to the Commissioner\nto discontinue the assessment program and terminate the program, the\nCommissioner shall within fifteen (15) days following receipt of the request\nconvene the board to review and act on the request. The board, after reviewing the\nrequest and conducting whatever proceedings are deemed appropriate and necessary\nin connection with the request, may terminate the program effective at the end of\nthe year in which the board action is taken; and, in this event, the Commissioner\nshall notify, by registered or certified mail, the handlers affected thereby of the\ntermination of the program.","path":["KRS Chapter 247"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11849","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:00Z","sha256":"5aeaab2827b013be783deccd8e00007cf3c7d9d16a5715b0363761cfdaf4e009","source_id":"us-ky","stale":false,"prev":"us-ky/krs-247.863","next":"us-ky/krs-247.865"},"notice":"GroundRules: Original legal text.
