{"data":{"id":"us-ky/krs-248.707","jurisdiction":"us-ky","citation":"KRS 248.707","heading":"Agricultural Development  Board.","body":"(1) The Agricultural Development Board is created as a political subdivision of the\nCommonwealth  to perform essential governmental and public functions by\nadministering funds to provide economic  assistance to the agriculture\ncommunity  of the Commonwealth.  The board shall be a public agency within\nthe meaning of KRS 61.805, 61.870, and other applicable statutes.\n(2) The board shall consist of sixteen (16) members  as follows:\n(a) Five (5) voting members  or their designees, as follows:\n1. The  Commissioner of Agriculture, who shall serve as chairperson.\nThe Commissioner of Agriculture may designate a representative to\nserve as chairperson in the Commissioner's absence;\n2. The Governor of the Commonwealth  of Kentucky;\n3. The secretary of the Cabinet for Economic Development;\n4. The  director of the University of Kentucky Cooperative Extension\nService; and\n5. The president of Kentucky State University; and\n(b) Eleven (11) voting members  appointed by the Commissioner, who shall\nbe  geographically distributed throughout the state and  subject to\nconfirmation as provided in KRS  11.160(2). The members  shall be as\nfollows:\n1. Seven  (7) active farmers, at least four (4) of whom  shall be from\ncounties that are substantially tobacco-impacted, as determined by\na  formula that includes tobacco income as a percentage of total\npersonal income in the county, and at least two (2) of whom  shall\nhave experience in agricultural diversification;\n2. One  (1) representative of the Kentucky Farm Bureau;\n3. One  (1) representative of the Kentucky Chamber of Commerce, who\nshall be an agribusiness person;\n4. One  (1) attorney with farm  experience and  familiarity with\nagricultural policy; and\n5. One  (1) agricultural lender.\n(3) The members  appointed under subsection (2)(b)2. and 3. of this section shall\nbe chosen from a list of three (3) nominees submitted to the Commissioner by\neach of the respective organizations.\n(4) Consideration shall be given to racial and gender equity in the appointment of\nboard members.\n(5) The majority of the voting members  shall be active farmers.\n(6) Members  of the board shall be reimbursed for expenses incurred in the\nperformance of their duties.\n(7) Except as provided in paragraphs (a) to (d) of this subsection, The terms of the\nmembers  appointed by the Commissioner shall be for four (4) years and until\ntheir successors are appointed and confirmed. A vacancy on the board shall be\nfilled for the remainder of the unexpired term in the same  manner  as the\noriginal appointment. Members  may be reappointed. The initial appointments\nshall be for staggered terms, as follows:\n(a) Two  (2) members  shall be appointed for one (1) year;\n(b) Three (3) members  shall be appointed for two (2) years;\n(c) Three (3) members  shall be appointed for three (3) years; and\n(d) Three (3) members  shall be appointed for four (4) years.\n(8) The  board shall meet monthly, or at the call of the chair or a majority of the\nvoting members.\n(9) A quorum of the board shall consist of nine (9) voting members. A majority of\nthe voting members  present may act upon matters before the board.\n(10) The board shall be attached to the Department of Agriculture.\n(11) Staff services for the board shall be provided by the Department of Agriculture.\n(12) The  Agricultural Development Board shall not be subject to reorganization\nunder KRS Chapter 12.","path":["KRS Chapter 248"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50657","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:01Z","sha256":"e5bbd1b3a6f1bcd2d3d69ccb912432c77fb63cf2a0ac4ee9c0b6a571f5a4782a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-248.705","next":"us-ky/krs-248.709"},"notice":"GroundRules: Original legal text.
