{"data":{"id":"us-ky/krs-248.752","jurisdiction":"us-ky","citation":"KRS 248.752","heading":"Prohibited acts relating to cigarettes and cigarette packaging.","body":"No person shall:\n(1) Sell or distribute, in this Commonwealth; acquire, hold, own, possess, or transport\nin this Commonwealth; for sale or distribution in this Commonwealth; or import or\ncause to be imported into this Commonwealth for sale or distribution in this\nCommonwealth:\n(a) Any cigarettes the package of which:\n1. Bears any statement, label, stamp, sticker, or notice indicating that the\nmanufacturer did not intend the cigarettes to be sold, distributed, or used\nin the United States including, but not limited to, a label stating \"For\nExport Only,\" \"U.S. Tax Exempt,\" \"For Use Outside U.S.,\" or similar\nwording; or\n2. Does not comply with:\na. All requirements imposed by or in accordance with federal law\nregarding warnings, and other information on packages  of\ncigarettes manufactured, packaged, or imported for sale,\ndistribution, or use in the United States including, but not limited\nto, the precise warning label specified in the Federal Cigarette\nLabeling and Advertising Act, 15 U.S.C. sec. 1333; and\nb. All federal trademark and copyright laws;\n(b) Any cigarettes in violation of federal law or federal regulations, including, but\nnot limited to, cigarettes imported into the United States in violation of 26\nU.S.C. sec. 5754, 26 U.S.C. sec. 5704, 19 U.S.C. secs . 1681 -1681b, U.S.\nCustoms Law including Chapter 4, Subtitle IV of the Federal Tariff Act of\n1930, 19 U.S.C. secs. 1671 -1677n, or Pub. L. No. 106 -476, the Federal\nImported Cigarette Compliance Act of 2000; or\n(c) Any cigarettes for which there has not been  submitted to the Secretary of the\nUnited States Department of Health and Human Services the list or lists of the\ningredients added to tobacco in the manufacture of the cigarettes required by\nthe Federal Cigarette Labeling and Advertising Act, 15 U.S.C. sec. 1335a;\n(2) Alter the package of any cigarettes, prior to the sale or distribution to the ultimate\nconsumer, so as to remove, conceal, or obscure:\n(a) Any statement, label, stamp, sticker, or notice described in subsection\n(1)(a)2.a. of this section; or\n(b) Any health warning that is not specified in or does not conform with the\nrequirements of the Federal Cigarette Labeling and Advertising Act, 15\nU.S.C. sec. 1333; or\n(3) Affix any stamp required by KRS 138.146 or make other evidence of tax payment\nas pr ovided in KRS 138.155 to the package of any cigarettes described in\nsubsection (1) of this section or altered in violation of subsection (2) of this section.","path":["KRS Chapter 248"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11983","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:01Z","sha256":"59d74e99995f70e94f346bede00af29b1abdef7cf5e426642d801f622f91161e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-248.750","next":"us-ky/krs-248.754"},"notice":"GroundRules: Original legal text.
