{"data":{"id":"us-ky/krs-249.010","jurisdiction":"us-ky","citation":"KRS 249.010","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context requires otherwise:\n(1) \"Commissioner\" means the Commissioner of Agriculture.\n(2) \"Department\" means the Department of Agriculture.\n(3) \"Director\" means the director of the agricultural experiment station.\n(4) \"Pest\" means any insect, snail, slug, rodent, nematode, fungus, weed; and any other\nform of plant or animal life, or virus, bacterium, or other microorganism, except\nviruses, bacteria, or other microorganisms on or in living man or other living\nanimals, whic h is normally considered to be a pest, or which the department\ndeclares to be a pest.\n(5) \"Insect\" means any of the numerous small invertebrate animals generally having the\nbody more or less obviously segmented, for the most part belonging to the class\nInsecta, comprising six (6) legged, usually winged forms, as for example, beetles,\nbugs, bees, wasps, flies, and other allied classes of arthropods whose members are\nwingless and usually have more than six (6) legs, as for example, spiders, mites,\nticks, centipedes, and wood lice, and any other invertebrates which are destructive,\nconstitute a liability, and may be classed as pests.\n(6) \"Plant disease\" means any fungi, bacteria, nematodes, protozoans, and viruses\ninjurious to plants and plant products, and the  pathological condition in plants and\nplant products, caused by fungi, bacteria, nematodes, protozoans, and viruses.\n(7) \"Nursery stock\" means all field or container -grown and native trees, sod, shrubs,\nherbaceous perennials, vines, cuttings, grafts, scion s, buds, fruit -pits, and other\nseeds of fruit and ornamental trees and shrubs; also other plants and plant products\nfor, or capable of, propagation, excepting field, vegetable, and flower seeds,\nbedding plants, bulbs, and roots.\n(8) \"Nursery\" means any gro unds or premises on or in which nursery stock is\npropagated and grown, or from which nursery stock is collected for sale, or any\ngrounds or premises on or in which nursery stock is being fumigated, treated,\npacked, or stored.\n(9) \"Nurseryperson\" means any person who owns, leases, manages, or is in charge of a\nnursery, and who propagates nursery stock.\n(10) \"Nursery dealer\" means any person or landscaper not a grower of nursery stock in\nthis Commonwealth who:\n(a) Buys, sells, ships, or distributes nursery st ock for commercial or monetary\ngain in the Commonwealth of Kentucky;\n(b) Makes landscape plans or plants nursery stock and negotiates in the purchase\nof nursery stock for his clients; or\n(c) Transplants or moves nursery stock from place to place within this state for\nother persons for a consideration in payment for the nursery stock, for the\nplanting of the nursery stock, or for both nursery stock and planting.\n(11) \"Person\" means any individu al, partnership, association, or any organized group of\npersons whether incorporated or not.\n(12) \"Weed\" means any plant which grows where not wanted.\n(13) \"Plants and plant products\" means any trees, shrubs, vines, forage and cereal plants,\nand fruit, vegetables, roots, bulbs, seeds, wood, lumber, and all other parts of plants\nor plant products.","path":["KRS Chapter 249"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11994","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:01Z","sha256":"fb8e6b0e1d792937abf00265f8206cb62dbb189d7051004b89252ed62a78c919","source_id":"us-ky","stale":false,"prev":"us-ky/krs-249.005","next":"us-ky/krs-249.020"},"notice":"GroundRules: Original legal text.
