{"data":{"id":"us-ky/krs-249.060","jurisdiction":"us-ky","citation":"KRS 249.060","heading":"Nurseries and dealers to be licensed -- Fees.","body":"(1) Every resident nursery or dealer selling nursery stock in this state shall annually file\ncredentials with the state entomologist. If these credentials are satisfactory to the\nstate entomologist, the director, and the Commissioner, the state entomologist sh all,\nupon payment by the nursery or dealer of the fee set out in subsection (2) of this\nsection, issue it a license authorizing it to do business in the state.\n(2) Payment of fees shall be made according to the following rates:\n(a) Class A nursery: nurseri es that are actively growing nursery stock with the\nintent of selling shall pay an annual fee of forty dollars ($40), plus one dollar\nand fifty cents ($1.50) per acre.\n(b) Class B nursery: nurseries and garden centers that do not grow their nursery\nstock, but do overwinter a portion of their stock, shall pay an annual fee of\nforty dollars ($40).\n(c) Class A dealer: landscapers and businesses who do not grow or overwinter\ntheir nursery stock but whose primary business involves the sale or planting of\nnursery stock shall pay an annual fee of forty dollars ($40).\n(d) Class B dealer: businesses whose primary business is not the sale of nursery\nstock shall pay an annual fee of twenty-five dollars ($25).\n(3) Any person soliciting orders for or delivering trees or plants in this state shall carry\nwith him a copy of his license which he shall show to prospective buyers,\npurchasers, county officials, or agents of the state entomologist, on demand.","path":["KRS Chapter 249"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12002","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:02Z","sha256":"49738b17ccc62ac7668b651199544055833f13484124968e1495d06d6e26c8b9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-249.055","next":"us-ky/krs-249.062"},"notice":"GroundRules: Original legal text.
