{"data":{"id":"us-ky/krs-249.070","jurisdiction":"us-ky","citation":"KRS 249.070","heading":"Entomologist to inspect nurseries and order management of plant pests --","body":"Shipment of affected stock prohibited -- Exception.\n(1) All nurseries in the Commonwealth of Kentucky shall be inspected by the state\nentomologist, his deputy, or by a nursery in spector, once each year. The state\nentomologist may collect specimens of plant material in order to make cultures and\npositive identifications of plant pests. The state entomologist also may inspect\nnursery stock which is stored in cellars, heeling in grou nds, or warehouses, to\nascertain whether it is infested with insect pests or plant diseases. If, upon the\ninspection of any nursery, it appears that the nursery and its premises are not\ninfected or infested with insect pests and plant diseases, the state e ntomologist shall\nissue to the nursery a certificate of inspection. The certificate of inspection shall be\nvalid through June 30 of the following year. This certificate shall be prominently\ndisplayed in the main office of the building.\n(2) If the nursery a nd its premises are infected or infested with insect pests and plant\ndiseases, the state entomologist shall notify the owners or managers of the nurseries,\nand shall also notify, in writing, the owner of any affected nursery stock to take such\nmeasures, on  or before a certain day, for the management of plant pests as have\nbeen shown to be effectual.\n(3) The owner or manager of the affected nursery shall, within the time specified, take\nsteps for the mitigation of plant pests.\n(4) No owner or manager of affe cted nursery stock shall sell or offer for sale, ship,\ndeliver, or remove from a nursery any nursery stock affected with plant pests, until\nthe stock has been officially inspected and a certificate covering it has been issued\nby the state entomologist.\n(5) The provisions of this section do not apply to florists' greenhouse plants nor to\nflowers or cuttings.","path":["KRS Chapter 249"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12004","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:02Z","sha256":"7426dabffcc598125ab02738ef3fec4578a0fea7b3fc46df64c5020644ab37dd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-249.062","next":"us-ky/krs-249.080"},"notice":"GroundRules: Original legal text.
