{"data":{"id":"us-ky/krs-24a.176","jurisdiction":"us-ky","citation":"KRS 24A.176","heading":"Additional costs imposed in criminal cases -- Funds distributed to local","body":"governments and counties -- Funds used for police, jails, and transport of\nprisoners.\n(1) For the purposes of this section:\n(a) \"Local government\" means a city, county, charter c ounty, urban -county, or\nconsolidated local government; and\n(b) \"Police department\" means a police department created by a local government\nwhich employs one (1) or more officers certified pursuant to KRS 15.380 to\n15.404.\n(2) In criminal cases a fee of twe nty dollars ($20) shall be added to the costs imposed\nby KRS 24A.175 that the defendant is required to pay.\n(3) The circuit clerk shall pay the funds from fees collected under this section to the\nFinance and Administration Cabinet pursuant to KRS 24A.175 f or distribution as\nprovided in subsection (5) of this section to local governments with police\ndepartments or local governments that contract for police services, and to counties\nwith fiscal responsibilities for jails or the transporting of prisoners.\n(4) All funds distributed to local governments shall be used for payment of expenses\nfor operation of the local government's police department or contracted police\nservices. All funds distributed to counties with fiscal responsibilities for jails or the\ntransporting of prisoners shall be used for the payment of costs associated with the\nhousing or transporting of prisoners.\n(5) Payments shall be distributed quarterly by the Finance and Administration Cabinet\nbeginning October 1, 2004, as follows:\n(a) Thirty per cent (30%) of the total shall be distributed equally to all local\ngovernments with police departments or local governments that contract for\npolice services;\n(b) Fifty percent (50%) of the total shall be distributed to local governments with\npolice departments on a per capita basis according to the number of certified\npolice officers employed by the police department on July 1 each year or\nproviding services to the local government pursuant to a contract on July 1 of\neach year. For purposes of this subsecti on, each local government that\ncontracts for police services shall be considered to employ one (1) police\nofficer for each sixty thousand dollars ($60,000) it expends during each fiscal\nyear for police services under a written contract; and\n(c) Twenty percent (20%) of the total shall be distributed equally to counties with\nfiscal responsibilities for jails or the transporting of prisoners.\n(6) On or before August 1 of each year, the Justice and Public Safety Cabinet shall\ncertify to the Finance and Administ ration Cabinet the number of certified police\nofficers employed by each local government.\n(7) On or before August 1 of each year, each local government contracting for police\nservices shall certify to the Finance and Administration Cabinet the amount of\nmoney expended for police services under a written contract during the previous\nfiscal year.\n(8) The Finance and Administration Cabinet shall promulgate administrative\nregulations pursuant to KRS Chapter 13A necessary for the administration of this\nsection.","path":["KRS Chapter 24A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20697","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:44Z","sha256":"800a8b62054495c7462fc1905705d95aae0588854471318f8bb964dc75ea01cc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-24a.175","next":"us-ky/krs-24a.1765"},"notice":"GroundRules: Original legal text.
