{"data":{"id":"us-ky/krs-250.031","jurisdiction":"us-ky","citation":"KRS 250.031","heading":"Application of KRS 250.021 to 250. 111.","body":"(1) The requirements and prohibitions of KRS 250.021 to 250.111 shall not apply:\n(a) To seed or grain not distributed for planting purposes.\n(b) To seed in storage in, or being transported or consigned to a conditioning\nestablishment, if the invoice or labelin g accompanying any shipment of the\nseed bears the statement \"seed for conditioning\"; and if any labeling or other\nrepresentation which may be made with respect to the unconditioned seed of\nthe same lot shall be subject to KRS 250.021 to 250.111.\n(c) To any carrier in respect to any seed transported or delivered for transportation\nin the ordinary course of its business as a carrier if the carrier is not engaged in\nproducing, conditioning, or distributing seed subject to the provisions of KRS\n250.021 to 250.111.\n(d) To seed grown, sold and delivered by a producer on his own premises to the\npurchaser himself. If, however, the seed is advertised by the public press,\ncircular, or catalog, or if the seed is delivered by a common carrier, the seed\nand the distribut or shall be subject to the certification and labeling\nrequirements of KRS 250.021 to 250.111.\n(2) No person shall be subject to the penalties of KRS 250.111 for having distributed\nseed which were incorrectly labeled or represented as to kind, species, and\nsubspecies, if appropriate, variety, type, or origin, which seed cannot be identified\nby examination thereof, unless he has failed to obtain an invoice, genuine grower's\ndeclaration, or other labeling information and to take other reasonable precautions\nto ensure the identity to be that stated. A genuine grower's declaration of variety\nshall affirm that the grower holds records of proof concerning parent seed, such as\ninvoice and label.\n(3) The director may by administrative regulation omit the requirement for variety\ndesignation on labels of seed kinds not commonly sold by variety name.","path":["KRS Chapter 250"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12078","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:02Z","sha256":"aea93b53ebc8baee7d4f8840b64fb1742b1117e5a143551d69faf89619890007","source_id":"us-ky","stale":false,"prev":"us-ky/krs-250.030","next":"us-ky/krs-250.040"},"notice":"GroundRules: Original legal text.
