{"data":{"id":"us-ky/krs-250.372","jurisdiction":"us-ky","citation":"KRS 250.372","heading":"Preemption of local legislation regulating fertilizer.","body":"(1) No city, town, county, or other political subdivision of the Commonwealth shall\nadopt or continue in effect any ordinance, resolution, rule, or regulation regarding\nthe registration, packaging, labeling, sale, storage, distribution, use, and application\nof fertilizers regulated pursuant to KRS 250.371. Local legislation in violation of\nthis section is void and unenforceable.\n(2) Nothing in this section shall be construed to:\n(a) Abrogate any authority afforded by the state statutes to any program cabinet\nestablished under KRS Chapter 12 or any state or federal mandated hazardous\nmaterials regulations or fire safety codes and comprehensive hazardous\nmaterials management program;\n(b) Abrogate the planning and zoning authority granted local government\npursuant to KRS Chapter 100; or\n(c) Waive any reporting requirement established by state or federal law or\nregulation.","path":["KRS Chapter 250"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12126","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:03Z","sha256":"0dccd802b8825a57541fa16018b4c35bf115a1ce5c11c06ea611a227a87c4afb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-250.371","next":"us-ky/krs-250.376"},"notice":"GroundRules: Original legal text.
