{"data":{"id":"us-ky/krs-250.381","jurisdiction":"us-ky","citation":"KRS 250.381","heading":"Inspection fee -- Quarterly statements.","body":"(1) There shall be paid to the Kentucky Agricultural Experiment Station for all\nfertilizers distributed in this state to nonregistrants or nonlicensees an inspection fee\nat the rate of fifty cents ($0.50) per ton; except sales or exchanges between\nimporters, manufacturers, distributors, licensees, or registrants are exempted.\n(2) Every registrant or licensee who distributes fertilizer in the state shall file on forms\napproved by the director a quarterly statement setting forth the number of net tons\nof each gra de of fertilizer distributed in this state, the county of the consignee, the\nform in which the fertilizer was distributed, e.g., bags, bulk, or liquid, and whether\nthe fertilizer was for farm or nonfarm use. The report shall be due on or before the\nlast day of January, April, July, and October of each year, and upon the filing of the\nstatement the registrant or licensee shall pay the inspection fee at the rate stated in\nsubsection (1) of this section. If the tonnage report is not filed and the payment of\ninspection fees is not made within fifteen (15) days after the due date, a collection\nfee, amounting to ten percent (10%), with a minimum of fifty dollars ($50), of the\namount due shall be assessed against the registrant or licensee and added to the\namount due.\n(3) If more than one (1) person is involved in the distribution of a fertilizer, the last\nperson who has the fertilizer registered or is licensed and who distributed to a\nnonregistrant dealer or consumer shall be responsible for reporting the tonnage a nd\npaying the inspection fee, unless the report and payment are made by a prior\ndistributor of the fertilizer.\n(4) On individual packages of fertilizer containing ten (10) pounds or less, there shall\nbe paid, in lieu of the inspection fee of fifty cents ($ 0.50) per ton required by\nsubsection (1) of this section, an annual inspection fee of fifty dollars ($50) for each\ngrade of each brand sold or distributed. If a person distributes fertilizer in packages\nof ten (10) pounds or less and in packages over ten (10) pounds, the annual fee shall\napply only to that portion distributed in packages of ten (10) pounds or less.\n(5) Fees collected shall be used for the payment of the costs of inspecting, sampling,\nanalyzing, and other expenses necessary for the administr ation of KRS 250.361 to\n250.451.\n(6) No information furnished to the director under this section shall be disclosed in a\nway to divulge the operation of any person.","path":["KRS Chapter 250"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12129","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:03Z","sha256":"9e35bddf47a14ca4b7f3d892f9f1d1b0d3943225f935a335b980f68cb2209851","source_id":"us-ky","stale":false,"prev":"us-ky/krs-250.380","next":"us-ky/krs-250.386"},"notice":"GroundRules: Original legal text.
