A fertilizer shall be deemed to be\nmisbranded:\n(1) If its labeling is false or misleading in any particular;\n(2) If it is distributed under the name of another fertilizer product;\n(3) If it is not label ed as required in KRS 250.376 and in accordance with regulations\nprescribed under KRS 250.421; or\n(4) If it purports to be or is represented as a fertilizer, or is represented as containing a\nplant nutrient or fertilizer, unless such plant nutrient or fer tilizer conforms to the\ndefinition of identity, if any, prescribed by regulation of the director; in adopting\nsuch regulations the director shall give due regard to commonly accepted definitions\nand official fertilizer terms such as those issued by the Ass ociation of American\nPlant Food Control officials.","path":["KRS Chapter 250"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12136","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:03Z","sha256":"8c294a210abd7fdeb93dbbcbc336a266d02db032f4f316cd32068dfcce8fe09b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-250.401","next":"us-ky/krs-250.410"},"notice":"GroundRules: Original legal text.
