{"data":{"id":"us-ky/krs-250.571","jurisdiction":"us-ky","citation":"KRS 250.571","heading":"Director to promulgate administrative regulations -- Notice.","body":"(1) The director is authorized to promulgate administrative regulations for commercial\nfeeds and pet foods that are specifically authorized in KRS 250.491 to 250.631 and\nother reasonable administrative regulations as may be necessary for the efficient\nenforcement of KRS 250.491 to 250.631. In the interest of uniformity the director\nshall by administrative regulation adopt, unless he determines that they are\ninconsistent with the provisions of KRS 250.491 to 250.631 or are not appropriate\nto conditions which exist in this state, the following:\n(a) The official definitions of feed ingredients and official feed terms adopted by\nthe Association of American Feed Control Officials and published in the\nofficial publication of that organization; and\n(b) Any regulation p romulgated pursuant to the authority of the Federal Food,\nDrug, and Cosmetic Act (21 U.S.C. secs. 301 et seq.), provided, that the\ndirector would have the authority under KRS 250.491 to 250.631 to\npromulgate the administrative regulations.\n(2) Before the i ssuance, amendment, or repeal of any regulation authorized by KRS\n250.491 to 250.631, the director shall publish the proposed administrative\nregulation, amendment, or notice to repeal an existing administrative regulation in a\nmanner reasonably calculated to give interested parties, including all current\nregistrants, adequate notice and shall afford all interested persons an opportunity to\npresent their views thereon, orally or in writing, within a reasonable period of time.\nAfter consideration of all views  presented by interested persons, the director shall\ntake appropriate action to issue the proposed administrative regulation or to amend\nor repeal an existing administrative regulation. The provisions of this subsection\nnotwithstanding, if the director, pu rsuant to the authority of KRS 250.491 to\n250.631, adopts the official definitions of feed ingredients and official feed terms of\nthe Association of American Feed Control Officials, or regulations promulgated\npursuant to the authority of the Federal Food, Drug, and Cosmetic Act, any\namendment or modification adopted by the association or by the Secretary of Health\nand Human Services in the case of regulations promulgated pursuant to the Federal\nFood, Drug, and Cosmetic Act shall be adopted automatically und er KRS 250.491\nto 250.631 without regard to the publication of the notice required by this\nsubsection, unless the director specifically determines that the amendment or\nmodification shall not be adopted.","path":["KRS Chapter 250"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12181","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:04Z","sha256":"9f6e8c3da0fa2f5fe8c6b7b94c7a85e73e3015dd9ed28b8b43938063123c77f8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-250.570","next":"us-ky/krs-250.580"},"notice":"GroundRules: Original legal text.
