{"data":{"id":"us-ky/krs-251.990","jurisdiction":"us-ky","citation":"KRS 251.990","heading":"Penalties for chapter.","body":"(1) Except as provided otherwise in this section, any person who violates a provision of\nthis chapter shall be guilty of a violation for the first offense and fined not more\nthan five hundred dollars ($500). He or she shall be guilty of a Class A\nmisdemeanor a nd shall be fined not more than one thousand dollars ($1,000) or\nimprisoned for up to six (6) months, or both, for each subsequent offense. Each day\nof operation in violation of the provisions of this chapter shall constitute a separate\noffense.\n(2) Any person who operates as a grain warehouse operator or a grain dealer without a\nlicense shall be fined not more than ten thousand dollars ($10,000) for each\nviolation, not to exceed a total of five hundred thousand dollars ($500,000), or\nimprisoned for at least one (1) but not more than five (5) years, or both.\n(3) Any person who intentionally refuses or fails to pay moneys collected for\nassessment of grain under the Kentucky grain insurance fund as set forth in KRS\n251.640 shall be subject to a fine of not mor e than five hundred dollars ($500), or\nimprisoned for not more than six (6) months, or both.\n(4) Any person who fails to comply with the requirement in KRS 251.375 to maintain\nat all times grain in storage, rights in grain, proceeds from the sale of grain,  or a\ncombination of the grain, rights, and proceeds equal to eighty percent (80%) of the\nvalue of a licensed grain storage establishment's unpaid obligations to producers for\ngrain delivered under a forward pricing contract shall be fined not more than te n\nthousand dollars ($10,000) for each violation, not to exceed a total of five hundred\nthousand dollars ($500,000), or imprisoned for at least one (1) year but not more\nthan five (5) years, or both.\n(5) Any person who knowingly makes any false statement, r epresentation, or\ncertification, or who knowingly fails to make any statement, representation, or\ncertification in any record, report, or other document shall be fined not more than\none thousand dollars ($1,000) for each violation, not to exceed a total of  five\nhundred thousand dollars ($500,000), or imprisoned for at least one (1) year but not\nmore than five (5) years, or both.\n(6) Any person who transfers or disburses grain, property, or assets in violation of a\nprovision of this chapter shall be fined not more than ten thousand dollars ($10,000)\nfor each violation, not to exceed a total of five hundred thousand dollars\n($500,000), or be imprisoned for at least one (1) year but not more than five (5)\nyears, or both.\n(7) Except as permitted by law, any pers on who willfully and knowingly resists,\nprevents, impedes, or interferes with a representative of the board or the department\nin performance of the duties assigned by a provision of this chapter, shall upon\nconviction be fined not more than five thousand d ollars ($5,000) for each violation,\nor imprisoned for not more than one (1) year, or both.\n(8) If a business entity violates any provision of this chapter, or if it fails or refuses to\ncomply with any lawful order issued by a representative of the board or  the\ndepartment, then any director, officer, or agent of the business entity who willfully\nand knowingly authorized, ordered, or carried out the violation, failed, or refused to\ncomply with the lawful order shall be subject to the same penalties, fines, an d\nimprisonment as may be imposed upon a person in accordance with this section.\n(9) Any person who fails to renew a license within the time frame required by KRS\n251.355 shall be fined one hundred fifty dollars ($150).\n(10) All fines or penalties collected  from violators of the provisions of this chapter shall\nbe used to carry out the provisions of this chapter.","path":["KRS Chapter 251"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49431","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:05Z","sha256":"01d6d23b9f9aa7928fd3704cec4180d14a82c14921db9ea11e5d14578ecc4ae9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-251.740","next":"us-ky/krs-252.010"},"notice":"GroundRules: Original legal text.
