{"data":{"id":"us-ky/krs-260.175","jurisdiction":"us-ky","citation":"KRS 260.175","heading":"Kentucky small farm wineries support fund.","body":"(1) The Kentucky small farm wineries support fund is created as a separate revolving\nfund. The support fund shall consist of amounts transferred to the fund pursuant to\nthe provisions of subsection (2) of this section and any other proceeds from grants,\ncontributions, appropriations, or other moneys made available for the purposes of\nthe fund. Fund amounts not expended at the close of the fiscal year shall not lapse\nbut shall be carried forward into the next fiscal year. Any interest earnings of the\nfund shall become a part of the fund and shall not lapse.\n(2) A total of four hundred thousand dollars ($400,000) shall be deposited in the\nKentucky small farm wineries support fund each fiscal year from the general fund.\nThe funds shall be used by the Kentucky Grape and Wine Council as follows:\n(a) Two hundred thousand dollars ($200,000) of these funds shall be used for the\npromotion, advertising, and marketing in Kentucky of wine produced by small\nfarm wineries located in Kentucky. The Grape and Wine Council shall\ncollaborate with the Kentucky Department of Agriculture and the Kentucky\nDepartment of Tourism to develop a marketing plan that shall include brand\ndevelopment, direct mail and e -marketing, Web site development, collateral\nbrochures and maps, advertising, f amiliarization trips, a retail program, and\nany other topics that the marketing plan developers deem appropriate or that\nmay be established through the promulgation of administrative regulations;\n(b) One hundred thousand dollars ($100,000) of these funds s hall be used by the\nGrape and Wine Council, in collaboration with the Kentucky Department of\nAgriculture and the Kentucky Department of Tourism, to establish a local\nmarketing cost -share program. For the purposes of this section, \"local\nmarketing cost -share program\" means a mechanism to provide Kentucky\nsmall farm wineries with access to matching funds reimbursements for\nprojects that promote and market their products. Standards for the application\nfor, and receipt of, matching funds reimbursements authoriz ed in this section\nshall be established through the promulgation of administrative regulations;\n(c) Twenty-five thousand dollars ($25,000) of these funds shall be used for\nfunding the administrative costs of the Kentucky Grape and Wine Council.\nThe costs s hall include but not be limited to reimbursement for the council's\nappointed members' travel expenses while attending meetings of the council;\n(d) Seventy-five thousand dollars ($75,000) shall be used for the payment of fees\nto licensed wholesalers who app ly to the Kentucky Grape and Wine Council\nto participate in a wine distribution program established by the Kentucky\nGrape and Wine Council. A licensed wholesaler shall apply and shall be\neligible for consideration for the program. The licensed wholesaler shall agree\nto distribute the wine produced by small farm wineries licensed under KRS\n243.155 and shall agree to sell the wine to retailers for the same price the\nwholesaler paid for the wine; and\n(e) The funds allocated to each purpose under paragraphs (a)  to (d) of this\nsubsection shall be used exclusively for the purpose designated. Use of the\nfunds designated for each purpose shall be strictly adhered to, and the funds\nshall not be used to support any other purpose. If at the end of any fiscal year\nfunds designated for one (1) of the purposes are unused, the unused funds\nshall not lapse and shall be carried forth to the succeeding year for the original\npurpose designated.\n(3) The Kentucky Grape and Wine Council shall advise the Commissioner of the\nDepartment of Agriculture regarding promulgation of administrative regulations\nnecessary to carry out the provisions and purposes of subsection (2) of this section.\nThe Department of Agriculture shall collaborate with the Kentucky Department of\nTourism and the Ke ntucky Grape and Wine Council in developing any\nadministrative regulations promulgated under the authority of this section.","path":["KRS Chapter 260"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12560","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:08Z","sha256":"32bc66be5cc7e58415b277985f0d6f36353db6cf3979f0826a9afdbe94ea75ba","source_id":"us-ky","stale":false,"prev":"us-ky/krs-260.170","next":"us-ky/krs-260.180"},"notice":"GroundRules: Original legal text.
