{"data":{"id":"us-ky/krs-260.550","jurisdiction":"us-ky","citation":"KRS 260.550","heading":"Prohibition against buying, selling, or processing eggs without license --","body":"Exceptions -- Stop orders and withdraw from sale orders imposed for certain\nviolations.\n(1) No person shall buy, sell, trade, traffic, or process eggs in Kentucky without a\nlicense issued pursuant to the egg marketing law, with the following exceptions:\n(a) Hatcheries purchasing eggs to be used exclusively for hatching purposes;\n(b) Hotels, restaurants, and other eating places where all eggs purchased are\nserved in the establishment;\n(c) Bakeries, confectioneries, and ice cream manufacturers who use eggs in a\nmanufactured product;\n(d) Consumers buying eggs for their own consumption; or\n(e) Producers who sell only directly to consumers and do not exceed a sales limit\nof sixty (60) dozen eggs per calendar week.\n(2) Any person engaged in the act of selling shell eggs or egg products under any of the\nfollowing circumstances shall have all shell eggs and egg products placed under a\nstop order:\n(a) Selling or otherwise marketing shell eggs or egg products without a license;\n(b) Selling or otherwise marketing shell eggs or egg products without first\nsubmitting an emergency recall plan to the department; or\n(c) Failing to remit or pay fines owed to the department.\n(3) Any person engaged in  the act of selling or otherwise marketing shell eggs under\nthe following conditions shall have those eggs placed under a stop order for:\n(a) Failing to have the proper labels attached, as required by KRS 260.630; or\n(b) Failing to meet the tolerances of c onsumer grades and consumer grade quality\nstandards, as required by KRS 260.620.\n(4) Any person engaged in the act of selling or otherwise marketing shell eggs or egg\nproducts shall have these shell eggs or egg products placed under a withdraw from\nsale order for the following reasons:\n(a) Ambient temperature above forty-five (45) degrees Fahrenheit for a period of\nfour (4) hours or more; or\n(b) Contamination or any condition which may render the shell eggs or egg\nproducts unfit for human consumption.\nThe withdraw from sale order shall remain in effect until such time as the\ndisposition of the shell eggs or egg products has been determined by the department.","path":["KRS Chapter 260"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12596","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:09Z","sha256":"97488ab3f7652f3405f18e6cdedbef6aa229bb9e7c8090ce1cab70b7a00ecc81","source_id":"us-ky","stale":false,"prev":"us-ky/krs-260.540","next":"us-ky/krs-260.560"},"notice":"GroundRules: Original legal text.
