{"data":{"id":"us-ky/krs-260.600","jurisdiction":"us-ky","citation":"KRS 260.600","heading":"Licensing requirement -- Fees.","body":"(1) Any person requiring a license may obtain an application by calling the Kentucky\nDepartment of Agriculture, Division of Regulation and Inspection. A license may\nbe renewed when accompanied by a renewal application and the required fees. A\nlicense for the current year shall not be issued if there are past due license fees and\npenalties pending for previous years. With regard to shell egg dealers, wholesalers,\nand packers, and specialty egg processors, dealers, and wholesalers, all of the\nprevious year's asse ssment fees shall be current before licenses shall be renewed.\nAny person selling eggs without the required license will be subject to having the\neggs removed from sale until a license has been acquired.\n(2) A license is required of each handler of eggs se lling in the Commonwealth subject\nto the exceptions specified in KRS 260.550. The annual license fees are as follows,\nvarying for dealers, distributors, wholesalers, producers, and packers, according to\nthe average weekly volume of the month in which the l icensee handled the most\neggs during the preceding year:\n(a) Retailers   ................................................................................................$20.00\n(b) Shell egg dealers, distributors, wholesalers, producers, and packers within\nKentucky or out-of-state:\n1-25 cases or 1-750 dozen  ..............................................................$20.00\n26-50 cases or 751-1500 dozen  ......................................................$30.00\nOver 50 cases or over 1500 dozen  ..................................................$50.00\n(c) Specialty egg processors, dealers, and wholesalers within\nKentucky or out-of-state  .........................................................................$50.00.\n(3) Any egg handler engaged in more than one (1) type of activity for which a license is\nprovided shall pay that license fee which is the highest of the licenses prescribed for\neach type of activity in which he or she is engaged.\n(4) All eggs bought or sold wi thin the Commonwealth of Kentucky shall bear a two\ncent ($0.02) assessment fee for each fifteen (15) dozen shell egg lot or portion\nthereof. Pasteurized liquid and pasteurized frozen egg products shall be assessed a\nfee of one-half (1/2) cent ($0.005) per ten (10) pound lot. Dried, dehydrated, hard -\ncooked, or specialty egg products shall be assessed a fee of one cent ($0.01) per ten\n(10) pound lot. These assessment fees shall be assessed and paid one (1) time as\nagreed between responsible parties as the pro duct moves through the distribution\nnetwork. All reports and fees are due monthly and shall be received by the\ndepartment prior to the fifteenth of the month following the month of activity,\nunless there is an agreement with the department to report and pa y these fees on a\nquarterly, semi-annual, or annual basis. In this event, the reports and fees shall be\nreceived prior to the fifteenth of the month following the period of activity.\n(5) All licenses shall expire on January 31 of each year. Handlers having more than one\n(1) place of business shall hold a license for each location.
