Produce as defined in 21 C.F.R pt. 112 and is a raw agricultural\ncommodity; or\n2. A fruit or vegetable, including but not limit ed to: almonds, apples,\napricots, apriums, artichokes -globe-type, Asian pears, avocados,\nbabacos, bananas, Belgian endive, blackberries, blueberries,\nboysenberries, Brazil nuts, broad beans, broccoli, Brussels sprouts,\nburdock, cabbages; Chinese cabbages i ncluding but not limited to bok\nchoy, mustard, and Napa; cantaloupes, carambolas, carrots, cauliflower,\nceleriac, celery, chayote fruit, sweet cherries, chestnuts, chicory roots\nand tops; citrus including but not limited to clementine, grapefruit,\nlemons, limes, mandarin, oranges, tangerines, tangors, and uniq fruit;\ncowpea beans, cress -garden, cucumbers, curly endive, currants,\ndandelion leaves, fennel -Florence, garlic, genip, gooseberries, grapes,\ngreen beans, guavas; herbs including but not limited to ba sil, chives,\ncilantro, oregano, and parsley; honeydew, huckleberries, Jerusalem\nartichokes, kale, kiwifruit, kohlrabi, kumquats, leek, lettuce, lychees,\nmacadamia nuts, mangos; other melons including but not limited to\nCanary, Crenshaw, and Persian; mulber ries, mushrooms, mustard\ngreens, nectarines, onions, papayas, parsnips, passion fruit, peaches,\npears, peas, and peas -pigeon; peppers including but not limited to bell\nand hot; pine nuts, pineapples, plantains, plums, plumcots, quince,\nradishes, raspberries, rhubarb, rutabagas, scallions, shallots, snow peas,\nsoursop, and spinach; sprouts including but not limited to alfalfa and\nmung bean; strawberries; summer squash including but not limited to\npatty pan, yellow, and zucchini; sweetsop, Swiss chard, taro, tomatoes,\nand turmeric; turnips including roots and tops; walnuts, watercress,\nwatermelons, and yams; and mixes of intact fruits and vegetables\nincluding but not limited to fruit baskets.\n(b) \"Covered produce\" does not include produce that is:\n1. Rarely co nsumed raw, specifically the produce on the following\nexhaustive list: asparagus, black beans, great northern beans, kidney\nbeans, lima beans, navy beans, pinto beans; garden beets including roots\nand tops; sugar beets, cashews, sour cherries, chickpeas, c ocoa beans,\ncoffee beans, collards, sweet corn, cranberries, and dates; dill including\nseeds and weed; eggplants, figs, ginger, hazelnuts, horseradish, lentils,\nokra, peanuts, pecans, peppermint, potatoes, pumpkins, winter squash,\nsweet potatoes, and water chestnuts;\n2. Produced by an individual for personal consumption or produced for\nconsumption on the farm or another farm under the same management;\nor\n3. Not a raw agricultural commodity;\n(2) \"Covered farm\" means a farm or farm mixed-type facility that:\n(a) Has an average annual monetary value of produce sold during the previous\nthree (3) year period of more than twenty-five thousand dollars ($25,000) on a\nrolling basis, adjusted for inflation using 2011 as the baseline year for the\ncalculation of the adjustment; and\n(b) Is subject to all applicable requirements of 21 C.F.R. pt. 112, KRS 260.765 to\n260.772, or any administrative regulation adopted pursuant to KRS 260.769,\nincluding registration requirements;\n(3) \"Department\" means the Kentucky Department of Agriculture;\n(4) \"Farm\" has the same meaning as in 21 C.F.R. sec. 112.3;\n(5) \"Farm mixed-type facility\" has the same meaning as in 21 C.F.R. sec. 112.3;\n(6) \"Food\" has the same meaning as in 21 C.F.R. sec. 112.3;\n(7) \"Produce\" has the same meaning as in 21 C.F.R. sec. 112.3;\n(8) \"Qualified end-user\" has the same meaning as in 21 C.F.R. sec. 112.3;\n(9) \"Raw agricultural commodity\" has the same meaning as in 21 C.F.R sec. 112.3; and\n(10) \"Stop movement order\" mean s an order issued by the department or its\nrepresentative that removes covered produce and stops the sale of the removed\nproduct until a release or change of order has been issued by the department or its\nrepresentative.","path":["KRS Chapter 260"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50267","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:09Z","sha256":"3ac7aa86b3e35487303ae3abd6788780de2eb926e63054d2807afaf8673623f0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-260.760","next":"us-ky/krs-260.766"},"notice":"GroundRules: Original legal text.
