{"data":{"id":"us-ky/krs-260.768","jurisdiction":"us-ky","citation":"KRS 260.768","heading":"Eligibility for exemption from requirements of KRS 260.765 to 260.772","body":"and some federal regulations.\n(1) Covered produce is eligible for a commercial processing exemption and the\nprovisions set forth in KRS 260.765 to 260.772 if:\n(a) The covered produce receives commercial processing that adequately reduces\nthe presence of microorganisms of public health significance;\n(b) The covered farm discloses in documents accompanying the produce, in\naccordance with the practice of the trade, that the foo d is \"not processed to\nadequately reduce the presence of microorganisms of public health\nsignificance\";\n(c) The covered farm complies with the requirements of 21 C.F.R. sec. 112.2;\n(d) The requirements of 21 C.F.R. pt. 112 Subpart A and Subpart Q apply to that\nproduce; and\n(e) An entity that provides a written assurance under 21 C.F.R. sec. 112.2 acts\nconsistently with the assurance and documents its actions taken to satisfy the\nwritten assurance.\n(2) A covered farm is not subject to KRS 260.765 to 260.772 if:\n(a) It satisfies the requirements in 21 C.F.R. secs. 112.5, 112.6, and 112.7;\n(b) An owner, operator, or agent in charge of a covered farm that is eligible for a\nqualified exemption is required to complete any training courses as designated\nby the department; and\n(c) The United States Food and Drug Administration or the department has not\nwithdrawn the covered farm's exemption in accordance with the requirements\nof 21 C.F.R pt. 112 Subpart R, KRS 260.765 to 260.772, or any\nadministrative regulation adopted pursuant to KRS 260.769.\n(3) A covered farm is eligible for a qualified exemption and associated modified\nrequirements in a calendar year if:\n(a) During the previous three (3) year period preceding the applicable calendar\nyear, the average annual monet ary value of the food the farm sold directly to\nqualified end-users during that period exceeded the average annual monetary\nvalue of the food the farm sold to all other buyers during that period; and\n(b) The average annual monetary value of all food the fa rm sold during the three\n(3) year period preceding the applicable calendar year was less than five\nhundred thousand dollars ($500,000), adjusted for inflation, using 2011 as the\nbaseline year for the calculation.\n(4) If a farm is eligible for a qualified e xemption in accordance with 21 C.F.R. sec.\n112.5, then the farm is subject to the requirements of 21 C.F.R. sec. 112 Subparts\nA, O, Q, and R and the modified requirements established in 21 C.F.R. secs. 112.6\nand 112.7.","path":["KRS Chapter 260"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50270","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:09Z","sha256":"61fc1ebbc6253a7ee8c03657b44a34d9e7b9235c90203e4950c629114d70db32","source_id":"us-ky","stale":false,"prev":"us-ky/krs-260.767","next":"us-ky/krs-260.769"},"notice":"GroundRules: Original legal text.
