{"data":{"id":"us-ky/krs-260.825","jurisdiction":"us-ky","citation":"KRS 260.825","heading":"Enforcement of KRS 260.775 to 260.845 -- Authority to promulgate","body":"administrative regulations.\n(1) The director shall enforce, administer, and implement the provisions of KRS\n260.775 to 260.845 through the promulgation of administrative regulations in\naccordance with KRS Chapter 13A.\n(2) For the purpose of the enforcement of KRS 260.775 to 260.845, the director is\nauthorized during normal business hours to enter any public or private premises,\nincluding any vehicle of transport, for the purpose of obtain ing samples, gaining\naccess to milk, milk samples, and records pertaining to milk handling, milk weights,\nmilk test results, and milk payments. The director may:\n(a) Collect samples obtained by sampler -weighers or testers for inspection\npurposes;\n(b) Inspect equipment and other devices used in testing or sampling and weighing\nmilk to determine the accuracy of this equipment and devices. Accuracy may\nbe determined by requiring sampler-weighers and testers to operate equipment\nand devices to determine the accuracy of equipment, devices, and procedures;\n(c) Condemn inaccurate or improperly operating equipment; and\n(d) Examine and copy records and take testimony for the purpose of ascertaining\nfacts necessary to administer KRS 260.775 to 260.845.\n(3) At the requ est of producers, processors, handlers, sampler -weighers, or testers, the\ndirector may test for milk components or other tests of milk quality.\n(4) The director shall employ qualified persons to assist in the enforcement of KRS\n260.775 to 260.845.\n(5) The director shall establish and maintain milk -testing facilities to determine if milk\nhas been sampled, weighed, and tested correctly. The testing facility established\nshall be officially named the \"Division of Regulatory Services Dairy Laboratory.\"\nThe direc tor shall, with approval of the board of trustees of the University of\nKentucky, fix the salaries of the analysts, inspectors, and supporting staff.\n(6) The director shall cooperate with other federal, state, and local enforcement\nagencies.","path":["KRS Chapter 260"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12653","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:10Z","sha256":"236036df24281729e2e7d426a2996b614244c760347a6cc29ddbc762e58af529","source_id":"us-ky","stale":false,"prev":"us-ky/krs-260.823","next":"us-ky/krs-260.830"},"notice":"GroundRules: Original legal text.
