{"data":{"id":"us-ky/krs-260.850","jurisdiction":"us-ky","citation":"KRS 260.850","heading":"Definitions for KRS 260.850 to 260.869.","body":"As used in KRS 260.850 to 260.869:\n(1) \"Commissioner\" means the Commissioner of the Kentucky Department of\nAgriculture;\n(2) \"Cultivating\" means planting, growing, and harvesting a plant or crop;\n(3) \"Department\" means the Kentucky Department of Agriculture;\n(4) \"Handling\" means possessing or st oring hemp for any period of time on premises\nowned, operated, or controlled by a person licensed to cultivate or process hemp.\n\"Handling\" also includes possessing or storing hemp in a vehicle for any period of\ntime other than during its actual transport f rom the premises of a licensed person to\ncultivate or process hemp to the premises of another licensed person;\n(5) \"Hemp\" or \"industrial hemp\":\n(a) Means the plant Cannabis sativa L. and any part of that plant, including the\nseeds thereof and all derivativ es, extracts, cannabinoids, isomers, acids, salts,\nand salts of isomers, whether growing or not, with a delta -9\ntetrahydrocannabinol concentration of not more than three -tenths of one\npercent (0.3%) on a dry weight basis; and\n(b) Does not include medicinal cannabis as defined in KRS 218B.010;\n(6) \"Hemp products\" or \"industrial hemp products\":\n(a) Means products derived from, or made by, processing hemp plants or plant\nparts; and\n(b) Does not include medicinal cannabis products as defined in KRS 218B.010;\n(7) \"Licensee\" means an individual or business entity possessing a license issued by the\ndepartment under the authority of this chapter to grow, handle, cultivate, process, or\nmarket hemp or hemp products;\n(8) \"Marketing\" means promoting or selling a product within the Commonwealth, in\nanother state, or outside of the United States. \"Marketing\" includes efforts to\nadvertise and gather information about the needs or preferences of poten tial\nconsumers or suppliers;\n(9) \"Processing\" means converting an agricultural commodity into a marketable form;\nand\n(10) \"University\" means an accredited institution of higher education located in the\nCommonwealth.","path":["KRS Chapter 260"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54049","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:10Z","sha256":"74e1fe7d2a1cbd78d2affe110b5f5b3dd2a173138f1b30ee5498f42ab44c8659","source_id":"us-ky","stale":false,"prev":"us-ky/krs-260.8451","next":"us-ky/krs-260.8505"},"notice":"GroundRules: Original legal text.
