{"data":{"id":"us-ky/krs-260.858","jurisdiction":"us-ky","citation":"KRS 260.858","heading":"Lawful and unlawful conduct.","body":"(1) Notwithstanding any other provision of law to the contrary, it is lawful for a\nlicensee, or his or her agent, to cultivate, handle, or process hemp or hemp products\nin the Commonwealth.\n(2) It is unlawful for a person who does not hold a license issued by the department, or\nwho is not an agent of a licensee, to cultivate, handle, process, or market living\nhemp plants or viable seeds, leaf materials, or floral materials derived from hemp.\nPenalties for persons who cultivate, handle, process, or market living  hemp plants\nor viable seeds, leaf materials, or floral materials derived from hemp without a\nlicense are the same as those penalties that are applicable to persons who violate\nKRS Chapter 218A, relating to marijuana.\n(3) It is unlawful for a person who do es not hold a license issued by the department, or\nwho is not an agent of a licensee, to possess hemp extract material having a delta -9\ntetrahydrocannabinol concentration in excess of three -tenths of one percent (0.3%).\nPenalties for persons who possess such hemp extract materials without a license are\nthe same as those penalties that are applicable to persons who violate KRS Chapter\n218A, relating to marijuana.\n(4) Nothing in this chapter authorizes any person to violate any federal or state law or\nregulation.","path":["KRS Chapter 260"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49788","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:10Z","sha256":"021d409c6108ac74ae00e73af2bf52a57753c74e6b8a6274f0f9b49536cbcf71","source_id":"us-ky","stale":false,"prev":"us-ky/krs-260.857","next":"us-ky/krs-260.859"},"notice":"GroundRules: Original legal text.
