{"data":{"id":"us-ky/krs-260.990","jurisdiction":"us-ky","citation":"KRS 260.990","heading":"Penalties.","body":"(1) Any person who violates a stop order in violation of KRS 260.550(2) or (3) shall be\nfined one hundred dollars ($100) for the first offense, be fined two hundred fifty\ndollars ($250) for the second offense, and have his or her license revoked or\nsuspended or, if the person has no license, be fined one thousand dollars ($1,000)\nfor each subsequent offense.\n(2) Any person who violates a withdraw from sale order in violation of KRS\n260.550(4) shall be guilty of a Class B misdemeanor.\n(3) Any person who violates  KRS 260.600(4), involving an untimely payment of an\nassessment fee, shall be charged a penalty of ten percent (10%) of the original\namount and shall be required to pay this penalty in addition to the original\nassessment fee. The original assessment fee an d penalties shall be compounded by\nten percent (10%) monthly until paid in full. Any assessment fee and penalties\nremaining unpaid for three (3) successive months shall result in a license\nrevocation.\n(4) Any person who fails to comply with KRS 260.610(6) shall be in violation of the\negg marketing law and may be subject to license suspension or revocation. In the\nevent of a suspension or revocation, a stop order shall be issued prohibiting the sale\nof the product. In the event that the original producer or plant is not required to be\nlicensed because of having no direct distribution in the state and the product is\ndistributed through other distribution channels, the producer or plant shall have its\nproduct placed under stop order and returned to the distribu tor. Further distribution\nin the state shall be prohibited until the department receives an emergency recall\nplan from the original producer or plant.\n(5) Any person who violates any of the shell egg labeling requirements set forth in KRS\n260.630 more than four (4) times within a calendar year shall be fined two hundred\nfifty dollars ($250) starting at the fifth offense, and an additional two hundred fifty\ndollars ($250) in addition to the previous fine for each subsequent offense.","path":["KRS Chapter 260"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12670","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:10Z","sha256":"81cfd8f7c9a5fef06393de14d362d3a438dfcb3a06cb6c5d4abbdcc8d89b1c15","source_id":"us-ky","stale":false,"prev":"us-ky/krs-260.960","next":"us-ky/krs-260.991"},"notice":"GroundRules: Original legal text.
