{"data":{"id":"us-ky/krs-262.010","jurisdiction":"us-ky","citation":"KRS 262.010","heading":"Definitions.","body":"(1) \"Board\" means the board of supervisors of a conservation district;\n(2) \"Commission\" means the Conservation Commission;\n(3) \"District\" means a conservation district whenever used in KRS 262.010 to 262.660\nor a watershed conservancy district whenever used in KRS 262.700 to 262.795;\n(4) \"Due notice\" means notice published in accordance with the legal notice provisions\nof KRS Chapter 424;\n(5) \"Infrastructure\" means the plant and assets required for maintaining a district office;\n(6) \"Land occupier\" or \"occupier of land\" includes any person other than the landowner\nwho is in possession of any lands lying within the district, whether as lessee or\notherwise;\n(7) \"Landowner\" or \"owner of land\" includes any person who holds legal or equitable\ntitle to the land within the district determined as follows:\n(a) By his, her, or their names appearing on the recorded deed to the land;\n(b) By title derived through a probated will or by the laws of descent and\ndistribution under KRS Chapter 391;\n(c) Where a minor or person adju dged mentally disabled is the owner of land\nwithin the district, the guardian or conservator or whoever has the power of\nattorney shall have the right to vote for such landowner under the provisions\nof KRS Chapter 262;\n(d) Where the will has not been probated by the date of the referendum or election\nas provided in KRS Chapter 262, the executor of the deceased landowner shall\nhave the right to vote for the devisee or devisees;\n(e) Where the land within the districts is held in trust, the trustee shall have the\nright to vote for the landowner under the provisions of KRS Chapter 262;\n(f) A landowner shall be entitled to but one (1) vote whenever he is given the\nright to vote under KRS Chapter 262 regardless of the number of tracts or\nparcels of land which he owns either wholly or in part, within the district;\n(g) Where a trustee, executor, guardian, conservator, or other person with\nauthority to vote for a landowner exercises such duty in relation to two (2) or\nmore estates or tracts of land, within a district, such person shall have the right\nto vote separately for each such landowner which he represents within the\ndistrict;\n(h) In the case of a dispute as to whether or not a person has the right to vote in an\nelection or referendum under the provisions of KRS Chapter 262, the person\nseeking such right must provide to the satisfaction of the polling\nsuperintendent that he has the right to vote under this section.\n(8) \"Supervisor\" means one (1) of the members of the governing body of a conservation\ndistrict.","path":["KRS Chapter 262"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12706","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:10Z","sha256":"e7738a33e27de870289d59e9f31d3d47b2667986efa41a54dfe673339fd587ff","source_id":"us-ky","stale":false,"prev":"us-ky/krs-261.990","next":"us-ky/krs-262.020"},"notice":"GroundRules: Original legal text.
