{"data":{"id":"us-ky/krs-262.140","jurisdiction":"us-ky","citation":"KRS 262.140","heading":"Commission to determine feasibility of district when majority favor.","body":"(1) The commission shall publish the result of the referendum held under KRS 262.120\nand shall then determine whether the operation of the district within the defined\nboundaries is administratively practicable and feasible. If the commission\ndetermines that th e operation of the district is not administratively practicable and\nfeasible, it shall record the determination and deny the petition. If the commission\ndetermines that the operation of the district is administratively practicable and\nfeasible, it shall record the determination and shall proceed with the organization of\nthe district in the manner provided in KRS 262.150. In making the determination\nthe commission shall give regard and weight to the attitudes of the owners and\noccupiers of lands lying within  the defined boundaries, the number of landowners\neligible to vote in the referendum who have voted, the proportion of the votes cast\nin the referendum in favor of the creation of the district to the total number of votes\ncast, the approximate wealth and i ncome of the landowners and occupiers of the\nproposed district, the probable expense of carrying on erosion -control operations\nwithin the district, and such other economic and social factors as may be relevant to\nthe determination, having due regard to the  legislative determinations set forth in\nKRS 262.020.\n(2) The commission shall not determine that the operation of the proposed district\nwithin the defined boundaries is administratively practicable and feasible unless at\nleast a majority of the votes cast  in the referendum upon the proposition of creation\nof the district have been cast in favor of creation of the district.","path":["KRS Chapter 262"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12723","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:11Z","sha256":"f6a2094ff43a4d5726ee361f692c23ce092b4a7ff6e914cb1a8d219bb69885bd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-262.130","next":"us-ky/krs-262.150"},"notice":"GroundRules: Original legal text.
