{"data":{"id":"us-ky/krs-262.160","jurisdiction":"us-ky","citation":"KRS 262.160","heading":"Supervisors to present application to Secretary of State and file statement","body":"of committee.\n(1) The three (3) supervisors appointed under KRS 262.150 shall present to the\nSecretary of State an application signed by them, which shall set forth the\nfollowing:\n(a) Recitals that a petition for the creation of the district was filed with the\ncommission pursuant to this chapter and that the proceedings were taken\npursuant to the petition; that the application is being filed in order to complete\nthe organizatio n of the district as a governmental subdivision and a public\nbody under this chapter; and that the commission has appointed them as\nsupervisors.\n(b) The name and official residence of each of the supervisors, together with a\ncertified copy of the appointments evidencing their right to office.\n(c) The term of office of each of the supervisors.\n(d) The name which is proposed for the district.\n(e) The location of the principal office of the supervisors of the district.\n(2) The application shall be subscribed a nd sworn to by each of the supervisors before\nan officer authorized to take and certify oaths, who shall certify upon the application\nthat he personally knows the supervisors and knows them to be the officers as\naffirmed in the application, and that each h as subscribed to the application in the\nofficer's presence.\n(3) The application shall be accompanied by a statement by the committee, which shall\ncertify by mere recitals, that:\n(a) A petition was filed, notice was issued and hearing was held.\n(b) The commission determined that there was need, in the interest of the public\nhealth, safety and welfare, for a district to function in the proposed territory\nand defined the boundaries of the territory.\n(c) Notice was given and a referendum held on the question of  the creation of the\ndistrict and the result of the referendum showed a majority of the votes cast in\nthe referendum to be in favor of the creation of the district.\n(d) The commission determined that the operation of the proposed district was\nadministratively practicable and feasible.\n(4) The statement shall set forth the boundaries of the district as they have been defined\nby the commission.","path":["KRS Chapter 262"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12725","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:11Z","sha256":"fbe6cf4089874f49d3ddce8883861f0e9fd63f7c2fa1990feb4fb926a6a72ccf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-262.150","next":"us-ky/krs-262.170"},"notice":"GroundRules: Original legal text.
