{"data":{"id":"us-ky/krs-262.390","jurisdiction":"us-ky","citation":"KRS 262.390","heading":"Votes necessary for approval -- Effect of regulation.","body":"(1) The board shall not enact a proposed land -use regulation into law unless at least\nninety percent (90%) of the votes cast in the referendum have been cast for approval\nof the proposed regulation, and unless landowners voting to enact the proposed\nregulation own at least eighty percent (80%) of the land within the district.\n(2) The approval of the regulation by ninety percent (90%) of the votes cast in the\nreferendum shall not require the board to enact the proposed regulation into law.\n(3) Land-use regulations, proposed after the board has determined that uncontrolled soil\nerosion on some lands within the district is causing damage to other lands within\nthe district, and prescribed in regulations adopted by the board shall have the force\nand effect of law in the district.\n(4) Land-use regulations apply to publicly owned lands, and shall be observed by\nagencies administering such lands.","path":["KRS Chapter 262"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12748","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:11Z","sha256":"71e20f2a334df2a45e0decfb6e8ea9b2def68afaf7f42e8bc7bd6a3b1e7ddf34","source_id":"us-ky","stale":false,"prev":"us-ky/krs-262.380","next":"us-ky/krs-262.400"},"notice":"GroundRules: Original legal text.
