{"data":{"id":"us-ky/krs-262.525","jurisdiction":"us-ky","citation":"KRS 262.525","heading":"Consolidation of districts.","body":"(1) A petition for consolidating two (2) or more districts shall contain a unanimous\nresolution by each board of supervisors and filed with the commission requesting\nthe mutual consolidation of these districts. The petition shall contain, as a\nminimum, the pro posed name of the consolidated district, a description of the\nterritory of the district, a statement that there is a need  for the consolidation and\nthat the consolidation is in the interest of each board of supervisors and the general\npublic, and other in formation required by the commission. The commission may\nconduct public meetings and public hearings for the consideration of the petition.\n(2) Within sixty (60) days after a petition for consolidation of two (2) or more districts\nhas been received by the commission, it shall give due notice of the consolidation\nbeing considered and allow comments to be received for a minimum of thirty (30)\ndays.\n(3) The commission shall determine the feasibility of the petition to consolidate the\ndistricts, and if the comm ission determines that the consolidation is feasible, the\ncommission shall certify that determination to each of the district boards involved in\nthe request. In making that determination the commission shall give regard and\nweight to the attitudes of each board of supervisors, the attitudes of owners and\noccupiers of lands lying within the district, and other economic and social factors\nrelevant to the determination.\n(4) Upon receipt from the commission of a certification that the commission has\ndetermined that the consideration is feasible, the boards shall proceed to consolidate\nthe affairs of the districts. The boards shall file a verified application with the\nSecretary of State for the dissolution of the existing districts and the establishment\nof a new consolidated district. The application shall state the proposed procedure,\nthe seven (7) supervisors to remain on the newly -formed board appointed by the\ncommission, and set forth a full accounting of all assets and resources consolidated\nfrom each distric t into the newly -formed district. The Secretary of State shall issue\nto the board a certificate of consolidation and shall record a copy of the certificate in\nhis office.\n(5) Application to the Secretary of State shall provide the following information:\n(a) The name which is proposed for the new district;\n(b) The land to be included in the new district; and\n(c) The term of office of each of the supervisors to serve on the newly -formed\nboard of supervisors.","path":["KRS Chapter 262"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12762","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:11Z","sha256":"bdea55f98f3feac0a9e795814473e0a94a282919c262d1d41cce97bd35835cb3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-262.520","next":"us-ky/krs-262.530"},"notice":"GroundRules: Original legal text.
