{"data":{"id":"us-ky/krs-262.550","jurisdiction":"us-ky","citation":"KRS 262.550","heading":"Commission to determine feasibility of continuance of district.","body":"(1) The commission shall publish the result of the referendum and shall determine\nwhether the continued operation of the district within the defined boundaries is\nadministratively practicable and feasible. If the commission determines that the\ncontinued operat ion of the district is administratively practicable and feasible, it\nshall record the determination and deny the petition. If the commission determines\nthat the continued operation of the district is not administratively practicable and\nfeasible, it shall record that determination and shall certify that determination to the\nboard of the district. In making that determination the commission shall give regard\nand weight to the attitudes of the owners and occupiers of lands lying within the\ndistrict, the numbe r of landowners eligible to vote in the referendum who have\nvoted, the proportion of the votes cast in the referendum in favor of the\ndiscontinuance of the district to the total number of votes cast, the approximate\nwealth and income of the landowners and occupiers of the district, the probable\nexpense of carrying on erosion -control operations within the district and such other\neconomic and social factors as are relevant to the determination.\n(2) The commission shall not determine that the continued operat ion of the district is\nadministratively practicable and feasible unless at least a majority of the votes cast\nin the referendum have been cast in favor of the continuance of the district.","path":["KRS Chapter 262"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12765","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:11Z","sha256":"14a2a742568b0e2dbfcae60e03a03840d637f01c3c5f509dadffb0795f516d37","source_id":"us-ky","stale":false,"prev":"us-ky/krs-262.540","next":"us-ky/krs-262.560"},"notice":"GroundRules: Original legal text.
