{"data":{"id":"us-ky/krs-262.720","jurisdiction":"us-ky","citation":"KRS 262.720","heading":"Notice -- Parties -- Hearing -- Determination -- Proposed maximum","body":"budget.\n(1) Within thirty (30) days after such petition has been filed with the board of\nsupervisors, it shall cause due notice to be given as provided in KRS 262.010(4) of\nthe hearing upon the practicability and feasibility of creating such subdistrict. All\ninterested parties shall have the right to attend such hearing and be heard. If it shall\nappear at the hearing that other lands should be included or that lands included in\nthe petition should be excluded, the board of supervisors may permit such inclusion\nor exclusion, provided the land area involved still meets the requirements of KRS\n262.705.\n(2) If it appears upon the hearing that it may be desirable to include within the proposed\ndistrict, territory outside of the area within which due notice of the hearing  has been\ngiven, the hearing shall be adjourned and due notice of a further hearing shall be\ngiven throughout the entire area considered for inclusion in the district and a further\nhearing shall be held. After final hearing, if the board of supervisors det ermines,\nupon the facts presented at the hearing and upon other available information, that\nthere is need, in the interest of the public health, safety and welfare for such a\ndistrict to function in the territory considered, it shall make and record the\ndetermination and shall define, by metes and bounds, or by recognizable terrain\nfeatures and description, the boundaries of the watershed district.\n(3) If the board determines after the hearing that it is not feasible for such district to\nfunction in the ter ritory considered, it shall make and record the determination and\nshall deny the petition.\n(4) If the board determines that there is a need for a conservancy district, the board of\nsupervisors shall establish a proposed maximum budget for the maintenance o f the\nproposed conservancy district, to be funded either by millage or flat rate sufficient\nto meet the budget.","path":["KRS Chapter 262"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12786","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:11Z","sha256":"a1228493b804522dc3126461d3f040e77a9da9daabeb1051f69f1099abae8d00","source_id":"us-ky","stale":false,"prev":"us-ky/krs-262.715","next":"us-ky/krs-262.725"},"notice":"GroundRules: Original legal text.
