{"data":{"id":"us-ky/krs-262.902","jurisdiction":"us-ky","citation":"KRS 262.902","heading":"Legislative findings.","body":"(1) The General Assembly hereby finds and declares that it is a policy of the\nCommonwealth to retain agriculture and enhance the contribution that agriculture\nmakes to its economy. A program to retain and enhance agriculture is in the\neconomic best interests o f the Commonwealth and, consequently, constitutes a\npublic benefit that contributes to the health, safety, and general welfare of the\nresidents of the Commonwealth and the nation.\n(2) The General Assembly further finds and declares that the use of the\nCommonwealth's funds for the purpose of paying in whole or part the cost of\nacquiring agricultural conservation easements as set forth in KRS 262.900 to\n262.920, including any costs necessarily incident to the acquisition, sale, issuance,\nand delivery of the f unds, and the monitoring and enforcement of agricultural\nconservation easements, or to the participation of any party for these purposes, will\npromote the public health, safety, and general welfare of the people of the\nCommonwealth.\n(3) Further, it is the purpose of KRS 262.900 to 262.920 to:\n(a) Establish procedures for the acquisition of agricultural conservation easements\nin order to ensure that lands currently in agricultural use will continue to\nremain available for agriculture and not be converted to other land uses, and\nthat landowners who participate in this program will be fairly compensated for\ntheir agreement to accept deed restrictions limiting the use of their property;\n(b) Encourage landowners to make a long -term commitment to agriculture by\noffering them financial incentives and security that land use will remain\nstable;\n(c) Protect normal farming operations in agricultural areas from incompatible\nnonfarming uses that may render farming impracticable;\n(d) Protect normal farming operations from complaints of public nuisance against\nnormal farming operations; and\n(e) Maximize the use of agricultural conservation easement purchase funds and\nprotect the investment of taxpayers in agricultural conservation easements.","path":["KRS Chapter 262"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12814","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:12Z","sha256":"e66a58d0f947aa9b65cd53332f05fa90da00cf9b51f4154c02c70c8566ce17b8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-262.900","next":"us-ky/krs-262.904"},"notice":"GroundRules: Original legal text.
